ORDINANCE NO: 2006-251 "AN ORDINANCE AMENDING CITY ORDINANCE NO. 2006-251 ENTITLED: "AN ORDINANCE GOVERNING THE FRANCHISING/LICENSING AND REGULATION OF MOTORIZED TRICYCLE SERVICE OPERATION IN THE CITY OF PAGADIAN AND IMPOSING CHARGES LEGALIZATION AND PENALTIES FOR VIOLATION", AS AMENDED, PARTICULARLY SECTIONS 11, 17 AND 18 THEREOF" Be it ordained by the Sangguniang Panlungsod in session assembled that: SECTION 1. Section 11 of City Ordinance No. 1993-110 is hereby amended to incorporate a sub-paragraph (H) which shall now be read as follows: "SECTION 1. - Section 11 of City Ordinance No. 1993-110 is hereby amended to incorporate Sub Paragraph (H) which shall now be read as follows: Section 11. - x x x x x x x x x x x x SECTION 2. Section 17 of City Ordinance No. 1993-110 is likewise amended to read as follows: "Section 17. - Motorized Tricycle For-Hire shall bear a body number to be controlled by the Motorized Tricycle Franchising Regulatory Board (MTFRB) and said numbers shall be furnished the City's PNP and the Committee on Public Utilities, Transportation, Communications & Franchising of the Sangguniang Panlungsod." SECTION 3. - Section 18 of the same ordinance is hereby amended, which shall now be read as follows: "Section 18. - (a) The City Government through the Motorized Tricycle Franchising Regulatory Board (MTFRB) shall provide for each of the motorized tricycles legally operating in the city a machine pressed metal body number which shall, upon issuance, be permanently attached at the front portion of the motorized tricycle unit. The machine pressed metal body numbers shall specifically and conspicuously contain only the following embossed/etched information: The Tricycle Body Number in the center portion of the plate; The title "MOTORIZED TRICYCLE FRANCHISING REGULATORY BOARD (MTFRB)" to be inscribed to fit and occupy one line at the lowermost portion of the plate. The corporate seal of the City Government at the upper left side of the metal plate; A vacant space measuring two (2) inches by three (3) inches at the right uppermost portion of the plate for the City Government issued Sticker; The marking "WOW Pagadian" (per design and style contained in the sample provided) to be placed in the portion between the corporate seal and the City Government sticker above the embossed or etched tricycle body number; (b) Motorized tricycle operators or franchisees shall likewise cause the painting/marking of the body numbers, which painting/marking shall not be less than four (4) inches high in red color on a white background, in the following locations of their respective motorized tricycles unit(s): 1) back portion of the cab; and 2) inside the front portion of the first row seat. (c) A refundable cash deposit of One Hundred Fifty (P150.00) Pesos shall be required of all motorized tricycles-for-hire operators/franchisees for each and every machine pressed metal body number which amount shall only be returned/refunded to the registered owner of the tricycle body plate number(s) when the same is surrendered upon dropping of the unit. (d) In case of loss of such City Government issued body plate number motorized tricycle-for-hire, the operator/franchisee may apply for a replacement number upon payment of Three Hundred Fifty (P350.00) Pesos or the current cost for the manufacture of the plate, whichever is higher, after having submitted a duly notarized Affidavit attesting to such loss." SECTION 3. - Repealing Clause. Aside from those specified in this ordinance, all previous ordinances and/or parts thereof inconsistent with the above provisions are hereby repealed, modified and/or amended accordingly. SECTION 4. - Effectivity. This Ordinance shall take effect fifteen (15) days after its approval and after its publication in any newspaper of local circulation.
