ORDINANCE NO: 2005-248 "AN ORDINANCE ESTABLISHING THE SWINE BREEDING CENTER IN LENIENZA, PAGADIAN CITY AND IMPOSING FEES ON ARTIFICIAL INSEMINATION AND OTHER RELATED SERVICES THEREON" BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED: SECTION 1. TITLE - This ordinance shall be known as "AN ORDINANCE ESTABLISHING THE SWINE BREEDING CENTER IN LENIENZA, PAGADIAN CITY AND IMPOSING FEES ON ARTIFICIAL INSEMINATION AND OTHER RELATED SERVICES THEREON" SECTION 2. SERVICES AND CORRESPONDING PAYMENT 2.1 An amount of P500.00 shall be paid by the sow owner for every artificial insemination services conducted and administered by technicians from the Office of the City Veterinarian, or 2.2 Through mutual written consent, through a Memorandum of Agreement between the sow owner and the City Veterinarian for the latter to have the first choice of one piglet as payment for the artificial insemination from among the piglets produced. 2.3 Veterinary and technical services shall be provided by the Office of the City Veterinarian should necessity arises for free. SECTION 3. DISPERSAL 3.1 The piglet/s chosen as payment from the artificial insemination shall be dispersed or sold to any interested swine raiser based on the prevailing market price per kilogram live weight of the piglet. In the case of dispersed fatteners, upon the signing of the contract between the Office of the City Veterinarian and the recipient, the hog shall be sold at market weight of not less than 90 kilograms at prevailing market price per kilogram live weight and the gross proceeds of such sale shall be divided equally or at fifty-fifty percent (50%-50%) between the Breeding Center and the recipient of the dispersed fattener. In the case of dispersed weaners raised as gilts for subsequent breeding, the recipient shall repay the Office of the City Veterinarian with three (3) piglets from the first litter produced with the Office of the City Veterinarian having the first choice from among the piglets. Having repaid three (3) piglets, the ownership of the same gilt-sow shall then become that of the recipient. All piglets repaid to the Swine Breeding Center/Office of the City Veterinarian shall then be dispersed to any interested party. SECTION 4. DUTIES AND RESPONSIBILITIES OF THE RECIPIENTS. In all cases, it shall be the responsibility of every recipient of either dispersed weaners or fatteners to provide proper feed and care to the dispersed hog according to sound standards of feeding and management. It shall also be the responsibility of the recipient to immediately inform the Office of the City Veterinarian should the dispersed hog become ill or be in need of veterinary attention. The Office of the City Veterinarian reserves the right to revoke the contract and withdraw the said dispersed hog should the recipient fails to uphold his counterpart of the agreement in any manner or form. SECTION 5. THE COMMITTEE 5.1 The Committee on Agriculture, Fisheries and Agrarian Reform shall from time to time check and monitor the proper implementation of this ordinance and the proper management of funds and activities of the Swine Breeding Center. 5.2 In every execution of Memorandum of Agreement or contract signing between the Office of the City Veterinarian and the recipient of dispersals, there shall always be concurrence or prior approval from the Committee and final approval by the City Mayor before such undertaking be consummated. 5.3 The Committee shall at all times must formally and properly be informed by the Office of the City Veterinarian prior to selling of piglets or hogs and/or even dispersals for breeding or fattening. Every financial request by the Office of the City Veterinarian, for whatever purpose it will serve to the Swine Breeding Center, that will be taken out from the Special Account, shall at all times pass through the Committee for information and approval prior to its release. The Office of the City Veterinarian shall furnish the Committee a periodic report of its activities and/or accomplishment relative to the Swine Breeding program and all other related services including among others, but not limited to, the name of recipients of dispersals, number of dispersed animals and etc. SECTION 6. MAINTENANCE OF A SPECIAL ACCOUNT 6.1 There shall be SPECIAL ACCOUNT under the General Fund Proper (Sub Code 01) established and maintained for the Swine Breeding Center under the Office of the City Veterinarian subject to the usual accounting and auditing rules and procedure. 6.2 All cash fees and sales of piglet/s shall be remitted to the Swine Breeding Special Account. 6.3 Accrued funds thereon shall be utilized to cover expenses of the Breeding Center such as acquisition of replacement breeding stocks, emergency purchase of feeds, veterinary drugs and biologics, construction supplies for repair and maintenance, payment of utilities, including the payment of salaries of all personnel working at the said Breeding Center and other sundries incidental to the daily operations of the facility. SECTION 7. FORMULATION OF THE IMPLEMENTING RULES AND REGULATIONS The Executive Department through the Office of the City Veterinarian and the City Treasurer shall, within thirty (30) days after the approval of this ordinance, formulate the necessary implementing rules and regulations for its implementation, which IRR shall take effect only upon concurrence thereof by the Sangguniang Panlungsod. SECTION 8. REPEALING CLAUSE. All resolutions, ordinances or laws of local effect inconsistent with this ordinance are hereby modified, superseded or repealed accordingly. SECTION 9. SEPARABILITY CLAUSE Any section or provision of this ordinance which may be unconstitutional shall not affect the other section(s) or provision(s) hereof. SECTION 10. EFFECTIVITY. This ordinance shall take effect upon its approval.
