ORDINANCE NO: 2004-242

"AN ORDINANCE PRESCRIBING THE OPERATIONS OF THE CITY SLAUGHTERHOUSE, THE IMPOSITION OF THE NEW RATES OF FEES FOR SLAUGHTERING, AND OTHER PERTINENT SERVICES RENDERED BY THE CITY GOVERNMENT OF  PAGADIAN."
	Be it ordained by the Sangguniang Panlungsod (8th City Council) in session assembled:
SECTION 1. TITLE. 	This Ordinance shall be known as "An Ordinance Prescribing the Operations of the City Slaughterhouse, the Imposition of the New Rates of Fees for Slaughtering, and Other Pertinent Services Rendered by the City Government of Pagadian."
SECTION 2. STATEMENT OF POLICY. The operation of the slaughterhouse shall be the responsibility of the City Government of Pagadian, under the supervision of the Office of the City Veterinarian.  It shall be a cooperative effort within the allied departments of the City Government to ensure its smooth operation, to maintain and repair the slaughterhouse equipment and facilities, and to ensure that fees and other charges on the services rendered be promptly collected. It shall likewise be the responsibility of the City Government, through the Office of the City Veterinarian, to safeguard the meat consuming public in general by implementing existing meat inspection rules and regulations as promulgated by the National Meat Inspection Commission.
SECTION 3. DEFINITION OF TERMS.
Slaughterhouse - refers to any establishment for the slaughtering of livestock for human consumption. In this case, the Pagadian City Slaughterhouse located at Barangay Napolan interchangeably referred hereinafter as the City Abattoir.
Slaughtering For Home Consumption - slaughtering of animals by any person(s) for his own personal purpose; the consumption of such animal shall be exclusively by him, members of his immediate household and his non-paying guests. The meat and meat products produced from such practice shall not be used in any manner for commerce or personal profit.
Doson Fees - refers to the fees collected from special requests for the slaughtering of food animals after regular operating hours of the City Abattoir, excluding Christmas Day and New Year's Day, All Saints Day, Pagadian City Fiesta and Easter Sunday.
Hot Meat - refers to meat coming from animals clandestinely slaughtered and have not undergone ante and/or post-mortem inspections by qualified meat inspectors.
Corral Fees - refers to the payment for the use of the animal stockyard and holding pen as depository for animals to be slaughtered.
Stockyard Penalty Fees - refers to the fees assessed for those animals deposited within the slaughterhouse premises for examination but which are consequently denied permit for slaughter and have exceeded twelve (12) hours of confinement.  The owner/depositor of the animal will not be charged of such fee if the animal, which is denied permit for slaughter, is removed from the slaughterhouse premises in less than twelve (12) hours after admission and examination of the documents and its fitness for slaughter.
Weighing Fees - the service fees collected for weighing the animals prior to ante-mortem inspection.
Ante-Mortem Inspection Fees - the fees collected by the City Government for the inspection of food animals to determine its fitness prior to slaughter.
Permit to Slaughter Fees - the fees charged for the permits issued by the Office of the City Veterinarian after determining and verifying the necessary documents of such livestock presented for slaughter. Only animals approved for slaughter shall be allowed into the City Abattoir premises.
Slaughter Fees - refer to the fees collected by the City Government for the actual services in the slaughtering of food animals in the City Abattoir.
Post-Mortem Inspection Fees - refer to the fees collected for the examination performed by trained meat inspectors on the carcass of livestock and/or poultry, including the entrails, to determine its fitness for human consumption.
Hoof, Tails, and Ears Scalding Fee for Large Animals - a fee collected for the scalding & processing of hoof, tails and ears after slaughtering.
Head Scalding - a fee collected for head scalding and cleaning.
Hide Scalding - a fee collected for hide scalding and cleaning.
Entrails fees - the fees collected by the City Government for the cleaning of the entrails of livestock, removing the ingesta to render it clean and fit for human consumption.
Meat Delivery Van Fee - refers to the fee collected by the City Government in conveying the livestock carcass (meat), its blood and entrails to the public market stalls or to accredited/licensed meat retail establishments.
Storage Fee - is the fee collected whenever a suspect carcass, which necessitates re-inspection at a later predetermined time, is withheld and refrigerated.
SECTION 4. LECHON HOUSE OPERATOR. Any individual-personal or juridical-or group of individuals owning and/or operating an establishment for roasting "lechon." All lechon house operators shall be required to have their animals due for roasting slaughtered at the City Abattoir only. 
SECTION 5. SCHEDULE OF FEES AND CHARGES. For the services rendered by the City Abattoir, the following fees and charges shall be imposed and collected:

SECTION 9. PENALTY CLAUSE. Any violation of the provisions aforestated herein regarding the rules and regulations of slaughtering promulgated under the authority of this Ordinance shall be penalized by a fine of not exceeding Two Thousand (P2,000.00) Pesos or an imprisonment of not less than one (1) month nor more than six (6) months, or both, at the discretion of the court.
SECTION 11. FORMULATION OF THE IMPLEMENTING RULES AND REGULATION. The City Veterinary Office shall head the preparation and formulation of the Implementing Rules and Regulation of this Ordinance, in cooperation with the City Legal Office, the City Health Office, the Environment & Natural Resources Division of City Mayor's Office, the City Engineers Office, the City Planning and Development Coordinator and the City Treasurer.
SECTION 12. SEPARABILITY CLAUSE. If for any reason any provision, section or part of this Ordinance is declared invalid or unconstitutional by a court of competent jurisdiction, such judgment shall not affect or impair the remaining provision, sections or parts which shall continue to be in force and effect.
SECTION 13. APPLICABILITY CLAUSE. All other matters relating to the impositions in this Ordinance shall be governed by the pertinent provisions of existing laws and other ordinances.
SECTION 14. REPEALING CLAUSE. All ordinances, rules and regulations or part(s) thereof which may be in conflict or inconsistent with any provisions of this Ordinance are hereby repealed or modified accordingly.
SECTION 15. EFFECTIVITY. This Ordinance shall take effect upon approval.
ENACTED AND APPROVED by the Sangguniang Panlungsod (8th City Council) of Pagadian City on its 17th Regular Session held on October 26, 2004 at the Sangguniang Panlungsod Session Hall.
