ORDINANCE NO: 2003-228 "AN ORDINANCE CREATING THE PHILHEALTH CAPITATION FUND (PCF) FROM THE PROCEEDS OF THE OUTPATIENT CONSULTATION AND DIAGNOSTIC BENEFIT PACKAGE TO BE PROVIDED BY THE PHILIPPINE HEALTH INSURANCE CORPORATION (PHILHEALTH) FOR QUALIFIED INDIGENT FAMILIES OF THE CITY OF PAGADIAN UNDER THE INDIGENT SECTOR COMPONENT OF THE NATIONAL HEALTH INSURANCE PROGRAM (NHIP)." BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED: Section 1. TITLE. This ordinance shall be called: "An Ordinance Creating The Philhealth Capitation Fund (PCF) From The Proceeds Of The Outpatient Consultation And Diagnostic Benefit Package To Be Provided By The Philippine Health Insurance Corporation (PHILHEALTH) For Qualified Indigent Families Of The City Of Pagadian Under The Indigent Sector Component Of The National Health Insurance Program (NHIP)." Section 2. DEFINITION OF TERMS. For purposes of this ordinance, the following terms shall be defined as follows: a) City - shall mean the City of Pagadian b) Corporation - refers to the Philippine Health Insurance Corporation (PHIC) or PHILHEALTH c) PCF - shall mean Philhealth Capitation Fund) Rural Health Units. d) (RHU) - shall mean the RHUs of San Pedro, Sta. Lucia, Balangasan, San Jose, and the main City Health Office and some future RHUs which maybe created. Section 3. ENROLLMENT IN THE INDIGENT PROGRAM PREMIUM PAYMENT. The City shall establish a schedule of enrollment of indigent families in the Medicare Para Sa Masa Program (MPMP) by percentage on a per annum basis and include the premium payment in its Annual Investment Plan. Section 4. ACCREDITATION OF THE CITY RURAL HEALTH UNITS (RHUS). The head of each RHU shall be responsible for their respective RHU accreditation with Philhealth; while the City Health Officer shall check if the said RHU accreditation has been complied with and completed. Section 5. USE, MANAGEMENT AND DISPOSITION OF PCF. The use, management and disposition of the PCF shall be governed by the following rules: The capitation amount shall be released on quarterly basis by PHIC under the foregoing conditions: Initial release shall be subject to prior accreditation of the City-owned and-managed Rural Health Units and the payment of premium contribution by the City; and Succeeding release of quarterly capitation shall be subject to the submission of required monitoring/evaluation reports, research and program development as provided for under the Implementing Guidelines of the Outpatient Consultation and Diagnostic Package and prior payment of premiums in case of quarterly mode of remittance. The disposition of the PCF shall be governed by the following rules: The disbursement and liquidation of the PCF shall be in accordance with pertinent government accounting and auditing rules and regulations; A separate book of accounts for PCF shall be maintained by the City; and The PCF shall be used only for the specified purposes stipulated in the Outpatient Consultation & Diagnostic Package Guidelines. The Corporation may withhold the release of the subsequent quarterly PCFs due to any of the following: Delay or non-payment of premium contributions; Violation of government accounting and auditing rules and regulations on disbursement and liquidation of the PCF; and Non-submission of the required reports as indicated in Sec. 5 par. 1.2 hereof. Section 6. IMPLEMENTING RULES & GUIDELINES. The City through the City Health Office, City Social Welfare and Development Office and the City Local Finance Committee shall formulate/promulgate rules, regulations and guidelines in the implementation of this Ordinance subject to the review and confirmation by the Sangguniang Panlungsod. Section 7. REPEALING CLAUSE. All ordinances, resolutions or laws of local effect not in consonance hereto are hereby modified, superseded or repealed accordingly. Section 8. SEPARABILITY CLAUSE. Any section or provision of this ordinance which may be declared unlawful or unconstitutional , shall not disturb the other effective sections or provisions hereto. Section 9. EFFECTIVITY. This ordinance shall take effect upon approval by the City Mayor.
