RESOLUTION NO. 2003-225 WHEREAS, Sections 16, 22, 23 and 25 under Article II of the Philippine Constitution of the Philippine Constitution enshrines the protection of the environment; WHEREAS, such fundamental policies are further amplified and strengthened in Article 25 of the Local Government Code and its Implementing Rules and Regulations; WHEREAS, this august body is cognizant of the vital importance of protecting and preserving the city's watershed areas in the promotion of sustainable development; NOW, THEREFORE, on motion duly seconded, it was RESOLVED that this Sangguniang Panlungsod, in session assembled, ordain, as it hereby ordains, the herein Ordinance, to wit: CITY ORDINANCE NO. 2003-225 "AN ORDINANCE DECLARING THE MOUNTAIN RANGES AND FOREST AREAS; THE WATER ZONES OF MURIAS, SUSONG DALAGA, PINUKIS, EASTERN KULABOG, LANAYAN, SANKAD, PIWAN, PARUKAN, URUANG BABOY, KANAYAW; ALL OF LISON VALLEY, LA SUERTE, PALPALAN, UPPER SIBATANG AND LOWER SIBATANG; THE SLOPING AGRICULTURAL RURAL AREAS OF POLOYAGAN AND BOMBA WHICH HAVE WATER ZONES ALL IN PAGADIAN CITY, WITH A TOTAL LAND AREA OF 33,750 HECTARES, MORE OR LESS, AS CRITICAL WATERSHED" SECTION 1. -This Ordinance shall be known and referred to as the Critical Watershed Ordinance of the City of Pagadian. SECTION 2. - That the mountain ranges and forest areas; the water zones of Murias, Susong Dalaga, Pinukis, Eastern Kulabog, Lanayan, Sankad, Piwan, Parukan, Uruang Baboy, Kanayaw; all of Lison Valley, La Suerte, Palpalan, Upper Sibatang And Lower Sibatang; the sloping agricultural rural areas of Poloyagan and Bomba which have water zones, with a total land area of 33,750 Hectares, more or less, are hereby declared and identified as Critical Watershed Areas. SECTION 3. - Watershed Development and Management Council, Composition and Functions. There shall be constituted a Watershed Development Council which shall be primarily responsible for the following: It shall function as the planning body for watershed development and management; It shall recommend to the City Development Council such plans, programs and projects for funding under the annual City Budget; It shall access development assistance from prospective donors and monitor the practicability and sustainability of all measures; The Watershed Development and Management Council shall be composed as hereunder specified. The sectoral representatives shall be appointed by the City Mayor: Chairman : City Mayor Vice Chairman : Catholic Bishop of Pagadian City Members : SP Committee Chair on Ecology Pagadian City Water District National Irrigation Administration CENR Officer-DENR National Commission on Indigenous Peoples 54 Punong Barangays President, Sangguniang Kabataan-City Federation Representative, Religious Sector/Other Denominations Representative, City Farmers Federation Representatives (3), Environmentally Concerned NGOs Representative, Business Sector Representative, Rotary Club of Pagadian Representative, Knights of Columbus of the Philippines SECTION 4. - For purposes of protecting the areas identified in this Ordinance from further degeneration, there shall be formulated a 25-year Development and Management Plan-a structured program on ecosystem management-through a Technical Working Committee herein created, in coordination with the national government and the neighboring municipalities. There shall be provided an appropriation of _______ for the expenses necessary in the formulation of the 25-year Development and Management Plan out of available funds of the City Government.
