ORDINANCE NO: 2003-224 "AN ORDINANCE PROVIDING FOR THE RENUMBERING OF ALL RESIDENTIAL, COMMERCIAL, INDUSTRIAL AND OTHER ESTABLISHMENTS/BUILDINGS IN THE CITY OF PAGADIAN, THEREBY AMENDING CITY ORDINANCE NO. 48, s. 1986." SECTION 1. TITLE. This ordinance shall be known and referred to as an ordinance providing for the Renumbering of all Residential, Commercial and Industrial Houses/Establishments/Buildings in the City of Pagadian. SECTION 2. RATES OF FEE. With the assistance of the different barangays, the City Government hereby regulates, imposes and levies different rates in the renumbering of residential, commercial and all other buildings/structures within the City of Pagadian. Residential Structures: For residential houses and sari-sari stores, the owner shall pay the amount of the actual cost of procured house plate number plus the amount of P30.00. B) Commercial Structures: For commercial buildings, office spaces, such as banks, cockpits, theaters, resorts, eateries, bars, supermart and similar stores, the proprietor shall pay the actual cost of the procured commercial plate number plus P60.00. C) Industrial/Institutional Structures: Buildings which are used as, but not limited to: warehouses, rice and corn mills, service stations, automotive shops, schools/colleges and other industrial structures, the proprietor shall pay the actual cost of the procured commercial plates plus P100.00. D) Government Structures: For all government buildings which are utilized for commercial purposes, except for the Pagadian City (Agora) Public Market, and the Integrated Bus Terminal (IBT), the actual occupant shall pay the amount of the actual cost of the procured house plate number plus the amount P60.00. SECTION 3. EXEMPTIONS. - Exempted from this ordinance are churches, mosques, and other places solely devoted for religious worship, government school buildings and all other government office buildings within the City of Pagadian. SECTION 4. BARANGAY SHARE. For the assistance rendered by the different barangays in the implementation of the pertinent provisions of this ordinance within their respective areas of jurisdiction, the Barangay Government shall be entitled to Forty Percent (40%) of the total amount collected minus the actual cost of house/commercial plate numbers. SECTION 5. PERIOD/TIME OF RENUMBERING. - Upon the effectivity of this ordinance and the availability of the house plate numbers, the same are to be allocated by the City Treasurer to the different barangays for its distribution in accordance with the pertinent provisions herein. The barangays shall be given three (3) months to comply with this ordinance and remit, on a monthly basis, with an inventory report stating therein, among others, the owners/proprietors of residential, commercial or industrial buildings/spaces as the case may be and the house plate numbers assigned to these buildings/spaces. SECTION 6. BASIS OF THE QUANTITY OF HOUSE PLATE NUMBERS. - The City Treasurer, in coordination with the Barangay Officials/Treasurer, Purok Officials, the City Assessor, the National Statistics Office, the COMELEC, and other appropriate agencies shall determine the number of house plate numbers that shall be procured and/or given/entrusted to the different Barangay Treasurers. SECTION 7. NEW BUILDINGS/STRUCTURES. - Within one month after the construction and completion of all residential, commercial and/or any other type of buildings within the jurisdiction of the barangay, the Barangay Treasurer shall collect from the owner/proprietor the corresponding amount as specified in Section 2 and ensure the issuance of the appropriate house plate numbers. SECTION 8. SEMI-ANNUAL SURVEY. - The barangays are hereby mandated to conduct semi-annual inspection within their jurisdiction to verify whether all residential, commercial and all other buildings are duly numbered. SECTION 9. SITE OF INSTALLATION. - Owners of residential buildings and owners or proprietors, as the case may be, of commercial buildings/spaces and other buildings are hereby mandated to install in a conspicuous place, preferably in the front part of the house, commercial building/space, business or office space or gate, the house plate number particularly assigned to the property. Loss of the plate number due to theft and/or any other circumstance should be reported to the authorities of the barangay-where such building or structure is located-within thirty (30) days. Thereafter, a replacement house plate number shall be issued upon payment of the actual cost of the plate number only. SECTION 10. IMPLEMENTING GUIDELINES - The City Mayor with the assistance of the City Treasurer, City Assessor and City Planning Office shall promulgate the implementing guidelines of this ordinance subject to review and approval of the Sangguniang Panlungsod. SECTION 11. SEPARABILITY CLAUSE - Any part or provision of this ordinance, which may be held invalid, the other parts or provision thereof not affected, shall continue to be in full force and effect. SECTION 12. REPEALING PROVISION - All ordinances, rules and regulations inconsistent with any provision of this ordinance are hereby repealed and modified accordingly. SECTION 13. PENAL PROVISION - Any person found violating this ordinance shall upon conviction of a competent court, be sentenced to an imprisonment of not less than one month but not more than three months or a fine of not more than Five Thousand Pesos (P5,000.00) or both at the discretion of the court. SECTION 14. EFFECTIVITY - This Ordinance shall take effect fifteen (15) days after its approval and after its publication in any newspaper of local circulation.
