ORDINANCE NO: 2003-220 "AN ORDINANCE INTENSIFYING THE USE OF IODIZED SALT IN THE CITY OF PAGADIAN" By virtue of the passage of Republic Act No. 8172 otherwise known as "An Act Promoting Salt Iodization Nationwide (ASIN), be it ordained by the Sangguniang Panlungsod of the City of Pagadian in session assembled that: SECTION 1. Title. This Ordinance shall be known as the INTENSIFICATION OF THE USE OF IODIZED SALT in the City of Pagadian. SECTION 2. Policy. It is the expressed policy of the Sangguniang Panlungsod of Pagadian City to actively participate in the program of the National and Local leadership in the elimination of micronutrient malnutrition in the country, particularly Iodine Deficiency Disorders (IDD) through the cost effective measures of salt iodization. SECTION 3. Definition of Terms. For purposes of this ordinance, the following terms shall mean: Micronutrient malnutrition. A disorder resulting from deficiencies in vitamin A, iron, iodine and seventy-eight (78) other micronutrients which the body needs in minute quantities everyday. Iodine deficiency disorders. A broad spectrum of deficiencies resulting from lack of iodine in the diet which leads to the reduction of intellectual and physical capacity affecting everyone who is iodine-deficient and may manifest as goiter, mental retardation, physical and mental defects, and cretinism. Food fortification. The addition of nutrients to processed foods at levels above the natural state. Salt iodization. The addition of iodine to salt intended for human or animal consumption in accordance with specifications as to form, fortificant, method, manner and composition as may be prescribed by the BFAD. Food-grade salt. Salt for human and animal consumption as distinguished from industrial salt. Industrial salt. Salt used in the treatment, processing, and/or manufacture of non-food commercial products. Large producer/manufacturer. One who produces, imports, trades in, or distributes salt exceeding two thousand (2,000) metric tons per year. Manufacturer. One, who produces, imports, trades in, and distributes salt. Regulatory requirements. The provisions of all applicable laws regulations, executive orders, and other enactments related to food quality and safety, purity, nutritional composition, and other aspect of food regulation or control. Small producer/manufacturer. One who produces, imports, trades in or distributes salt ranging from more than two (2) metric tons to three hundred (300) metric tons per year. Subsistence producer/manufacturer. One who produces, trades in or distributes salt not exceeding two (2) metric tons of salt per year. Medium producer/manufacturer. One who produces, imports, trades in or distribute salt ranging from more than three hundred (300) metric tons to two thousand (2,000) metric tons per year. SECTION 4. Applicability. This Ordinance shall be applicable within the entire territory and jurisdiction of the City of Pagadian and shall be implemented by the CITY NUTRITION COUNCIL in coordination with the City Health Office. SECTION 5. Legal basis. The basis of this ordinance is to ensure health and social services as embodied in Section 17 of the Local Government Code. SECTION 6. Salt Outlets. All salt producers/manufacturers (Small, Medium, Large or Subsistence), traders/suppliers and retailers shall sell only iodized salt which is meant to be FOOD GRADE SALT. SECTION 7. Commercial food establishments. All commercial food establishments such as restaurants, canteens, hotels, hospitals, caterers, carenderia and all other food outlets as well as food manufacturers shall use only iodized salt in their food preparation service. SECTION 8. Salt Iodization Program Action Team. For the effective implementation of this ordinance the Salt Iodization Program, Action Team (SIPAT) shall be organized through an Executive Order, which body shall: Formulate the implementing guidelines; Formulate the program plan; Conduct a periodic monitoring of the quality of iodized salt distributed and sold in the market and that being used by food establishments; and Develop and implement a promotional plan on the use of iodized salt. SECTION 9. Initial Budget. There shall be an appropriation in the amount of Twenty Five Thousand (P25,000.00) Pesos from the 20% development fund as initial budget to cover monitoring and promotion of the use of iodized salt. SECTION 10. Sanctions. Any Producer/Manufacturer, Distributor, Food outlets, restaurants, and stores who violate any provision of this ordinance after due notice and hearing shall: Be penalized in the amount of not less than One Thousand Pesos (P1,000.00) but more than Five Thousand Pesos (P5,000.00) maximum penalty based on the Local Government Code; and Its License to Operate issued by the Bureau of Food and Drugs be revoked. SECTION 11. Relation to Prior City Ordinances. Any provision of this ordinance which may substantially be the same as that of any existing city ordinance, shall be construed as a restatement and not a new enactment. SECTION 12. Repealing Clause. All previous City Ordinance not consistent with the provisions of this ordinance are hereby repealed. SECTION 13. Effectivity. The Ordinance shall take effect fifteen (15) days after its approval.
