ORDINANCE NO: 2001-192 "AN ORDINANCE PROHIBITING OWNERS OR OPERATORS OF INTERNET SERVICE SITES, JOINTS, CAFES, STATIONS, CENTERS OR ANY SIMILAR BUSINESS ENTITIES WITHIN THE TERRITORIAL JURISDICTION OF PAGADIAN CITY TO ALLOW PERSONS FIFTEEN (15) YEARS OLD AND BELOW AND/OR HIGH SCHOOL AND ELEMENTARY STUDENTS, TO USE/OPERATE ITS COMPUTER UNITS DURING SCHOOL HOURS FROM MONDAY TO FRIDAY" WHEREAS, the accelerating deregulation of the global economy portends Internet explosion as computer companies strive to develop their own brands to address the rising communication and information technology (IT) markets; WHEREAS, recently the Philippines was chosen by IT managers as the foremost cellphone text-user country of mobile wireless communication in South-East Asia; WHEREAS, Pagadian City is now experiencing the influx of Internet Service Provider (ISP) stations within its territorial jurisdiction. WHEREAS, on the upside, internet service provider (ISP) offers unprecedented instant access to world-class information on varied topics, but on the downside, it can also download an array of obscene literature and graphics relatively not suitable to users who are still minors; WHEREAS, a significant number of parents of high school and elementary students and/or minors with ages below fifteen (15) years old of Pagadian City are alarmed over the growing infatuation of their youngsters on the aforesaid high-end plaything; WHEREAS, it has been noted by some parents and teachers alike that a growing number of students, especially those belonging to the secondary level, skip their classes and sometimes spend their meal allowances to surf or browse on the electronic screens of the various Internet Service Providers (SPs) in the City; NOW THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN CITY, IN SESSION DULY ASSEMBLED, that SECTION 1. It shall be unlawful for any owner/operator of internet service sites, joints cafes, stations, centers or similar business entities within the territorial jurisdiction of Pagadian City to allow persons fifteen (15) years old and below and or High School and Elementary Students, to use/operate its computer units during school hours from Monday to Friday. SECTION 2. DEFINITIONS. INTERNET SERVICE.- refers to any computer-based communication and information technology sites, joints, cafes, stations, centers or similar business entities that provides mail and other related services. SCHOOL DAYS - from 7:00 A.M. to 5:00 P.M. Monday to Friday B. Subject minors and/or high school students found violating this ordinance shall be referred to the City Department of Social Welfare or the School guidance Counselor for proper guidance and counseling; SECTION 5. SAVING CLAUSE. Should any part of this ordinance be declared invalid or unconstitutional, the other parts not so declared shall remain in force and effect. SECTION 6. REPEALING CLAUSE. Any other ordinance or parts thereof inconsistent herewith are hereby repealed or modified accordingly. SECTION 7. EFFECTIVITY. This ordinance shall take effect four (4) consecutive weeks of posting in all offices and departments of the city government and at the public posting places of the Sangguniang Panlungsod and after its publication in a newspaper of general circulation in City of Pagadian for three (3) consecutive weeks. ENACTED AND APPROVED by the Sangguniang Panlungsod (6th City Council) of Pagadian City on its 131st Regular Session held on February 28, 2001 at the Sangguniang Panlungsod Session Hall.
