AN ORDINANCE CREATING AND ESTABLISHING THE PAGADIAN ANTI-DRUG ABUSE COUNCIL (PADAC) IN THE CITY OF PAGADIAN

ORDINANCE NO: 2000-189

"AN ORDINANCE CREATING AND ESTABLISHING THE PAGADIAN ANTI-DRUG ABUSE COUNCIL (PADAC) IN THE CITY OF PAGADIAN"

	WHEREAS, Section 15 of the Constitution provides that "the state shall protect and promote the right to health of the people and instill health consciousness among them."

	WHEREAS, consistent with this policy, local government units are mandated under RA 7160, otherwise known as the Local Government Code of 1991, particularly Section 16 thereof or the General Welfare Clause, to promote health and safety, improve public morals, maintain peace and order, and preserve the comfort and convenience of their inhabitants;

	WHEREAS, notwithstanding the foregoing policies, certain social adversities, particularly indiscriminate sale and use of prohibited drugs as well as regulated drugs, have been frustrating current initiatives aimed at promoting productive family life, community peace and harmony, and ultimately, nation-building and national development;

	WHEREAS, it is necessary to assist in the relentless pursuance of this particular initiatives in the local level and to eradicate the social adversities associated with illegal drugs and drugs abuse through the creation of a special body which will be tasked to oversee the attainment of the aforesaid objectives;

	NOW, THEREFORE, be it enacted by this Sangguniang Panlungsod in session assembled, that

Section 1. Creation and Purpose.  There is hereby created and established in the City of Pagadian a council, to be officially known as the Pagadian Anti-Drug council or PADAC for the primary purpose of effectively and efficiently monitoring and carrying out the programs and projects of the government designed to protect the general welfare and health of the local residents from the harmful effects of the illegal/prohibited drugs.

Section 2. Function of the PADAC. The Pagadian Anti-Drug Abuse Council shall have the following functions:
	
To conduct surveys, collate and maintain statistical data on all matters involving abuse of prohibited, illegal and regulated drugs, and other forms of substances known to produce harmful effects to the human body as well as the environment, which maybe of significant need in the formulation of measures for the attainment of the objectives of the office;

To recommend the conduct of educational programs on the prevention and suppressions of substance abuse designed for the youths and   parents as participants;

To report regularly to the City Mayor and the Sangguniang Panlungsod all pertinent activities of the office, their results, progress, assessments and recommendations;

To assist and supervise the organization of Barangay Anti-Drug Abuse Council and the formation of parents and youth organizations as well as the establishment of the so-called "Just say "NO" Clubs" in the schools and similar aggrupations in the City;

To design and produce information, education and communication materials such as pamphlets, posters and handouts, among others, for the awareness of the public;

To conduct periodic fund-raising projects and activities, the proceeds of which shall be used for the purchase and acquisition of relevant materials and/or equipment necessary for the operation, and attainment of the objectives, of the office;

To establish pertinent rules and regulations necessary for the efficient operation of the office and other related activities.

Section 3. Composition. The PADAC shall be composed of the following members to be appointed by the City Mayor and whose terms of office shall be co-terminus with the term of the appointing authority, unless otherwise terminated by the latter earlier:

3.1	Chairman	-	City Mayor

3.2	Vice Chairman	-	Chief of Police

3.3	Members	-	Vice Mayor
Chairman, Committee on Police, Fire & Public Safety, this Sanggunian
		-	City Administrator
		-	National Bureau of Investigation
		-	City Schools Division Superintendent
		-	City Prosecutor
		-	City Health Officer
		-	City Social Welfare and Development Officer
Representatives of the following Non-Government
		Organizations:
a)	Church and Defense Consultative Conference (CADENCE)
b)	Media Club of Pagadian, Inc. (MCPI)
c)	Mothers Association Against Dangerous Drugs (MAADD)
Pagadian Action Youth Organization (PAYO)

3.4	Coordinator	-	City Director, Department of the Interior and 
			Local Government (DILG), this City

3.5	Asst. Coordinator	-	Assistant City Director, Department of the Interior 
			and Local Government (DILG), this City

3.6	Secretariat	-	At least three (3) personnel of the DILG-City 
			Development Office

Section 4. Remuneration/Compensation. The Chairman and the Members of the PADAC shall render voluntary service, As such, they shall not be entitled to honorarium or any form of remuneration and compensation, except, however, when they are authorized to travel outside the City, their travel expenses shall be chargeable against the appropriations of the office. Such travels, however, should be connected and related to the purpose and intent of the PADAC.

Section 5.  Meetings and Quorum. The Chairman shall convene the members of the PADAC every 1st Wednesday of the month to tackle various illegal drug related concerns that are brought to the attention of the said Council for resolution or other appropriate actions. Special meetings may be convened by the Chairman as the need arise or upon the instance of a majority of the Council Members.

Section 6. Appropriations. For purposes of this Ordinance, there shall be a continuing appropriation of Five Hundred Thousand (P500,000.00) Pesos per annum for the operating expenses and maintenance costs of the PADAC.

Section 7.  Separability Clause. Any provision or provisions of this Ordinance that maybe declared by a competent court as invalid or unconstitutional shall not adversely affect the other provisions herein.

Section 8. Effectivity. This Ordinance shall take effect immediately upon its approval.

	ENACTED AND APPROVED by the Sangguniang Panlungsod (6th City Council) of Pagadian City on its 120th Regular Session held on December 6, 2000 at the Sangguniang Panlungsod Session Hall.
