ORDINANCE NO: 2000-187

"AN ORDINANCE CREATING THE POSITION OF ASSISTANT SECRETARY IN THE OFFICE OF THE SECRETARY TO THE SANGGUNIAN, LEGISLATIVE BRANCH, CITY GOVERNMENT OF PAGADIAN"

	WHEREAS, Section 76 of R.A. 7160, otherwise known as the Local Government Code of 1991 provides that "Every local government unit shall design and implement its own organizational structure and staffing pattern taking into consideration its service requirements and financial capability, subject to the minimum standards and guidelines prescribed by the Civil Service Commission; 

	WHEREAS, Memorandum Circular No. 19, s. 1992 of the Civil Service Commission, which set the Guidelines and Standards in the establishment of organizational structures and staffing patterns in the local government units, particularly Section 9 thereof, authorizes local government units to create other offices and positions not provided under Sections 3 and 4 thereof, provided, that they are the priority needs as identified by the Sanggunian, among others;

	WHEREAS, the position of Assistant Secretary in the Office of the Secretary to the Sanggunian is not among the mandatory and optional positions provided for under Sections 3 and 4 of MC No.19 of the CSC, notwithstanding the exigency of such position in the efficient and effective operation of the Office of the Secretary to the Sanggunian;

	NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod in session assembled that:

	Section 1. There shall be created in the Office of the Secretary to the Sanggunian the position of Assistant Secretary who shall be a career official with a rank and salary equal to an assistant department head. 

	Section 2. Qualification Requirements. The Assistant Secretary must be a citizen of the Philippines, a resident of Pagadian City, of good moral character, a holder of college degree preferably in law, commerce or public administration from a recognized college or university, a trust grade civil service eligible or its equivalent, excellent in written and oral English and must have at least a minimum of one (1) year experience on the job as enumerated in Section 3 of this Ordinance.

	Section 3. Duties and Responsibilities. The Assistant Secretary shall perform all duties and responsibilities of the Secretary to the Sanggunian as enumerated under Section 469 of R.A. 7160 in the absence of the latter and such other functions that may be delegated to him by the Secretary to the Sanggunian. 

	Section 4. The Assistant Secretary shall be appointed by the City Vice-Mayor with concurrence of the majority of all the members of the Sanggunian subject to civil service laws, rules and regulations. 

	Section 5. This Ordinance shall take effect immediately upon its approval.

	ENACTED AND APPROVED by the Sangguniang Panlungsod (6th City Council) of Pagadian City on its 108th Regular Session held on September 13, 2000 at the Sangguniang Panlungsod Session Hall.
