ORDINANCE NO: 2000-181

"AN ORDINANCE PROVIDING FOR THE AUTOMATIC SALARY GRADE ADJUSTMENT FOR ALL OFFICIALS AND EMPLOYEES OF THE CITY GOVERNMENT WHO ARE DUE FOR COMPULSORY RETIREMENT UPON REACHING THE AGE OF SIXTY-FIVE (65)"

Be it Ordained by the Sangguniang Panlungsod of Pagadian City in session assembled that:

	Section1. - Title of Ordinance. This Ordinance shall be called the "City Employees Retirement Ordinance".

Section 2. - Scope and Authority. Pursuant to the powers vested in local government units by the Local Government Code of 1991, it is hereby established as a policy to provide for Automatic Salary Grade Adjustment or ASGA for all officials and employees of the City Government due for compulsory retirement upon reaching the age of sixty-five (65).

	Section 3. - Automatic Salary Grade Adjustment or ASGA. An official or employee due to retire at his/her 65th birth anniversary shall be automatically adjusted to one (1) salary grade higher effective ninety (90) days before the date of retirement. The retiring official or employee shall be entitled to all benefits granted by law on the basis of the adjusted salary grade.

	Section 4. - Offices or Departments of the City Government with personnel who are due for compulsory retirement in the next ensuing year shall propose in the annual budget for the incoming year the inclusion of the computed retirement pay and benefits to be borne by the City Government and due the retiring employee in the budget of the Office or Department concerned. If this is not done, the Chief of Office or Department Head shall make the necessary official request to the Sangguniang Panlungsod to be properly endorsed by the City Mayor, at least sixty (60) days prior to the effectivity of the ASGA as indicated in Section 3 hereof.

	Section 5. - Any section or portion of this ordinance found to be inconsistent with national statutes and civil service laws and regulations shall not invalidate the other provisions which are within the scope and power of the local government unit under the principle of autonomy.

Section 6. - This Ordinance shall take effect immediately upon its approval.

 ENACTED AND APPROVED by the Sangguniang Panlungsod (6th City Council) of Pagadian City on its 91st Regular Session held on May 3, 2000 at the Sangguniang Panlungsod Session Hall.
