ORDINANCE NO: 2000-174 "AN ORDINANCE PROVIDING FOR THE MANAGEMENT, OPERATION AND MAINTENANCE OF THE INTEGRATED BUS TERMINAL AT BARANGAY DAO, PAGADIAN CITY; CREATING A CITY BUS TERMINAL BOARD; DEFINING ITS DUTIES AND RESPONSIBILITIES; FIXING THE FEES AND/OR CHARGES FOR THE USE OF THE SAID TERMINAL AND FOR OTHER PURPOSES" Be it ordained by the Sangguniang Panlungsod of Pagadian City in session assembled that: SECTION 1. - Statement of Policy. As a means of further improving the traffic condition in the City of Pagadian, promote peace and order, to render effective and efficient service to the riding public, it is hereby declared as a matter of policy that the City Government of Pagadian shall establish, operate and maintain an Integrated Bus Terminal at Barangay Dao. SECTION 2. - Scope and Coverage. This ordinance shall apply to passenger buses, jeepneys multicabs, passenger vans and all other public utility vehicles servicing passengers to and from and within Pagadian City. That the transfer of all terminals from the different parking areas around the City to the Integrated Bus Terminal shall be done by phase due to lack of space and facilities. The first phase (will transfer immediately after the approval of this ordinance) is composed of all buses: small, medium and large, plying the route to and from: Group A Group B Group C Molave Kapatagan Buug Dumingag Maranding Imelda Mahayag Tubod Malangas Josefina Iligan Alicia Tambulig Cagayan de Oro Kabasalan Bonifacio Siay Liloan Naga Tangub Ipil Oroquieta Zamboanga Ozamiz Dipolog The second phase (will transfer on or before the Fourth Quarter of year 2000) is composed of all buses plying the route from Pagadian City to and from: Group A Group B Group C San Miguel Bigong Navalan Lapuyan Nilo Midsalip V. Sagun Tigbao Suminot Margosatubig Tubod Ramon Magsaysay Dinas Diplo Aurora Dimataling Kumalarang Tabina Lakewood San Pablo Pitogo The third phase (will transfer on or before the Third Quarter of year 2001) is composed of all buses plying the route from Pagadian City to and from: Pulacan, Labangan, Tukuran, Buenavista, Balintawak, Dumalinao, Danlugan and all Barangays of Pagadian City. SECTION 3. - Creation of the Integrated Bus Terminal Board. In order to carry out the declared policy in Section 1, there is hereby created and constituted a board to be known as the "Integrated Bus Terminal Board" which shall be composed of the following: Chairman: The City Vice-Mayor Members: The Chairman, SP Committee on Commerce, Cooperatives, Trade and Industry The Chairman, SP Committee on Economic Enterprise The Chairman, SP Committee on Public Utilities and Communications The Chairman, SP Committee on Ways and Means Two (2) Presidents of the Bus/Jeepney Operators Associations Two (2) representatives of the Non-Government Organizations in the City and to be appointed by the City Mayor The City Administrator shall be the Secretary to the Board. SECTION 4. Terms of Office of the Members of the Integrated Bus Terminal Board. Members of the Board representing the Bus and Jeepney Operators and the two (2) accredited Non-Governmental Organizations shall serve for a period of one (1) year from the date of appointment while the rest shall hold office co-terminus with their terms as Chairmen of the respective Sanggunian Committees. SECTION 5. - Duties, Functions and Responsibilities of the Board. Upon its constitution, the Board shall propose and draft a code containing the following, to wit: Rules and regulations governing the operation, administration and maintenance of the Integrated Bus Terminal; Rules and policies regarding the use of the terminal premises by the management of the different passenger buses, jeepneys, multicabs, passenger vans, and all public utility vehicles servicing passengers to and from and within Pagadian City; Provision for the authorization and regulation of porterage and cargo handling at the terminal; Such other regulatory measures as may be necessary in the effective administration, maintenance and operation of the terminal. Any proposal involving the above-mentioned code of policies as determined by the Board shall only become effective and enforceable by the same upon the approval of the City Mayor and confirmation by the Sangguniang Panlungsod. SECTION 6. - Honorarium. The honorarium of the members of the Integrated Bus Terminal Board shall be finally determined by the Sangguniang Panlungsod. SECTION 7. - Time, Place and Manner of Meeting. Unless otherwise called by written note of the City Mayor, the Board shall meet once a month at such place and time as may be determined and agreed upon by the Board. SECTION 8. - General Supervision of the Board. The City Mayor shall exercise general supervision over the Board. SECTION 9. - Creation of a Special Committee. A Special Committee shall be created through an Executive Order issued by the City Mayor for the manner, mode and disposition of all rentable areas in the Integrated Bus Terminal including fees/rentals/charges thereof, with the suggested composition: Chairman: The City Treasurer or his duly authorized representative, it being a collecting arm; Vice-Chairman: The Vice Chairman, SP Committee on Ways and Means; Members: The City Legal Officer - to answer in case any question of law will arise; A representative of the City Mayor; A representative from the Non-Government Organization, preferably from the Transportation Organizations; The City Administrator or his duly authorized representative; The City Planning and Development Coordinator or his duly authorized representative SECTION 10. - Fees and Charges. Unless otherwise provided by law or an ordinance, the following fees and/or charges are hereby imposed for the use of the Integrated Bus Terminal: Passenger Vehicles (above 35 passengers) P25.00/departure Mini-buses (maximum of 35 passengers): Pagadian-Aurora route P15.00/departure Pagadian-Kumalarang route P15.00/departure Pagadian-Molave route P15.00/departure Beyond Molave-Aurora-Kumalarang-San Miguel P18.00/departure Multicab/Jeepney (maximum of 20 passengers) P10.00/departure Passenger Van P5.00/departure Jeepney/Multicab (plying Dumalinao-Tukuran- Labangan-and within Pagadian City) P2.00/departure Tricycles P1.00/departure The Board shall, from time to time, determine the reasonableness and effectiveness of the rates, fees and charges imposed herein. It shall make such recommendation through the City Mayor, in the manner of imposition of fees and/or charges, to the Sangguniang Panlungsod of Pagadian as the situation would warrant, or as the need arises at such rates other than those provided herein. SECTION 11. Collection and Disposal of Fees and/or Charges. The fees and/or charges herein provided shall be collected by the City Treasurer and/or his duly authorized deputies upon issuance of official receipts. Any fees and/or charges so collected shall accrue to a Trust Fund which is hereby created and shall only be disbursed solely for the repair, maintenance and operational expenditures of the Integrated Bus Terminal. SECTION 12. Routing Scheme of all Utility Vehicles. Passenger buses/jeepneys/ multicabs/passenger vans and all types of Public Utility Vehicles servicing passengers to and from and within Pagadian City plying the route to and from the Integrated Bus Terminal. Routing Scheme ( Phases I, II & III) Westbound Entry - To all types of vehicles under Phase I, II and III. Barangay Balintawak, then North Diversion Road then Rotunda, and straight to Integrated Bus Terminal (should unload passengers at IBT). Exit - The same for Phase I, II and III temporarily can use the old road (route) Eastbound Entry - To all types of vehicles under Phase I, II and III Pass through Barangay Tiguma then North Diversion Road then straight to the Integrated Bus Terminal (should unload passengers at IBT). Exit - The same (vice-versa for Phase I) Phase II and III can temporarily use the old route. Routing Scheme (Downtown to IBT) Multicab Route going to IBT from the Shopping Center (proposed parking area). From shopping center straight to Rotunda then right turn to the Integrated Bus Terminal. Route going to downtown Shopping Center. From the Integrated Bus Terminal straight to Rotunda left turn to Pajares Avenue, straight to Shopping Center. SECTION 13. - Prohibited Acts. It shall be prohibited for any passenger buses, jeepneys, multicabs, passenger vans and all types of public utility vehicles servicing passengers to and from and within Pagadian City to load/unload passengers in any place in the poblacion of the City of Pagadian except inside the Integrated Bus Terminal. It shall likewise be prohibited for any individual, firm or association to establish, maintain and operate any premises or terminal for loading and unloading of passengers until phases 2 and 3 shall have been fully implemented. Selling of any commodities, goods, and articles, except in the area or areas so designated by the Board for vending of said commodities goods and articles, shall also be strictly prohibited. SECTION 14. - Status of the existing terminals of passenger buses, jeepneys, multicabs, passenger vans, all types of public utility vehicles servicing passengers to and from and within Pagadian City. All existing terminals of passenger buses, jeepneys, multicabs, passenger vans and all types of utility vehicles servicing passengers plying to and from Pagadian City, except for tricycles, operated prior to the approval of this ordinance shall likewise be discontinued and after all such operation shall have been transferred to the Integrated Bus Terminal. The City Mayor shall also advise the respective operators of passenger buses, jeepneys, multicabs, passenger vans, all types of Public Utility Vehicles servicing passengers to Pagadian City and vice-versa to discontinue the operation of their terminals after they shall have transferred the same to the Integrated Bus Terminal. SECTION 15. - Transitory Provisions. Pending the appointment of the Terminal Supervisor and Staff, the City Mayor shall initially designate such personnel to operate and maintain the Integrated Bus terminal by detail or transfer from any department in the City Government of Pagadian, all of whom shall be under the direct operational control of the Board. Thereafter, the personnel necessary to effectively operate, manage and maintain the Integrated Bus Terminal shall be provided. SECTION 16. - Any violation of any provision of the herein ordinance shall subject the offenders/operators/drivers jointly and severally liable to pay an administrative fine of: P3,000.00 for the first offense; and P5,000.00 for the second offense and the revocation of the business permit. In case of failure to pay said fine, subject vehicles shall be impounded and may only be released upon payment of the fine herein imposed. Provided, further, that the offenders/operators/drivers shall undergo a seminar on traffic rules and regulations for one (1) day, in coordination with the Land Transportation Office. SECTION 17. - Separability Clause. Any provisions hereof that may be declared by any competent court to be invalid shall not affect the rest of the provisions not so declared illegal. SECTION 18. - Effectivity. This Ordinance shall take effect Thirty (30) days after publication. ENACTED AND APPROVED by the Sangguniang Panlungsod (6th City Council) of Pagadian City on its 81st Regular Session held on February 23, 2000 at the Sangguniang Panlungsod Session Hall.
