ORDINANCE NO: 1999-162 "AN ORDINANCE ESTABLISHING THE CITY POUND FOR ASTRAY ANIMALS" WHEREAS, astray animals are found to be loitering around the public places of the city scattering garbage especially at nighttime; WHEREAS, such astray animals hampers the aim of the clean and green program of the government in maintaining cleanliness and sanitation of the city; WHEREAS, in the need to dispose such astray animals, there is a need to establish a city pound to place them in the custody and control of the city government; NOW THEREFORE, on motion duly seconded, Be it Ordained by the Sangguniang Panlungsod (6th City Council) of Pagadian City in Session Assembled, That: SECTION 1. For the purpose of understanding this ordinance, the following words shall be construed to mean: 1.1 Astray Animals - means any animal not kept by any possessor/owner thereby causing the garbage in public places to scatter. 1.2 Owner/Possessor - means any person who is the sole or part owner of any dog or cat including any person who is in charge of the animal. The occupant of the premises on which any animal is found shall be presumed to be the owner until the contrary is proven. 1.3 Public Place - means plazas, street, alleys, roads, and sidewalks, school premises and grounds, canals and ditches, buildings and their premises, grounds, and parking areas owned by the government. 1.4 City Pound - means a place to be provided by the government in keeping astray animals. SECTION 2. Establishment Of A City Pound. In support to the City Ordinance No. 3, s. of 1973, as amended by City Ordinance No. 71 s. of 1990, a City Pound is to be established as a shelter to impounded animals that are found to be without any owner possessor who is responsible in feeding and taking care of such astray creatures. SECTION 3. Custody of Astray Animals. Any animal found by the police authorities, Barangay Tanods or any agents duly authorized by the local government which are loitering around and which causes the scattering of garbage in public places especially during nighttime shall be subjected to impoundment and shall be under the custody of the local government and will be placed in the City Pound until such time the right owner/possessor shall have settled the fine provided for by the further amended City Ordinance No. 71, s. of 1990 and shall assure the authorities to provide the animal with proper care. SECTION 4. This Ordinance shall take effect immediately upon approval.
