AN ORDINANCE CREATING AND ESTABLISHING THE PAGADIAN CITY OFFICE FOR SUBSTANCE ABUSE PREVENTION (POSAP) UNDER THE OFFICE OF THE CITY MAYOR AND APPROPRIATING FUNDS THEREOF

ORDINANCE NO: 1998-152


"AN ORDINANCE CREATING AND ESTABLISHING THE PAGADIAN CITY OFFICE FOR SUBSTANCE ABUSE PREVENTION (POSAP) UNDER THE OFFICE OF THE CITY MAYOR AND APPROPRIATING FUNDS THEREOF"

BE IT ORDAINED BY THIS SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. Creation and Purpose. There is hereby created and established in the City Government of Pagadian an office under the Office of the City Mayor, to be officially known as the Pagadian City Office for Substance Abuse Prevention or POSAP for the primary purpose of effectively and efficiently overseeing and carrying out the programs and projects of the city government designed to protect the general welfare and health of the local residents from the harmful effects of all kinds of substances.

SECTION 2.	Functions of the POSAP. The Pagadian City Office for Substance Abuse Prevention shall have the following functions:

2.1	To conduct surveys and collate and maintain statistical data on all matters involving abuse of prohibited, illegal and regulated drugs, alcohol, tobacco and other forms of substances known to produce harmful effects to the human body as well as the environment, which may be of significant need in the formulation of measures for the attainment of the objectives of the office;

2.2	To recommend the conduct of educational programs on the prevention and suppression of  substance abuse designed for the youths and parents as participants;

2.3	To report regularly to the City Mayor and the Sangguniang Panlungsod all pertinent activities of the office, their results, progress, assessments and recommendations;

2.4	To assist and supervise the organization of Substance Abuse Prevention Units in the barangay level and the formation of parents and youth organizations as well as the establishment of the so-called "Just say "No" Clubs" in the schools and similar aggregations in the City;

2.5	To coordinate, assist and support other government agencies and duly accredited government organizations that are actively involved in the control and prevention of substance abuse;

2.6	To design and produce information education and communication materials such as pamphlets, posters and handouts, among others, for the awareness of the public;

2.7	To conduct periodic fund-raising projects and activities, the proceeds of which shall be used for the purchase and acquisition of relevant materials and/or equipment necessary for the operation and attainment of the objectives of the office;

2.8	To establish pertinent rules and regulations necessary for the efficient operation of the office and other related activities.

SECTION 3. 	Composition. The POSAP shall be composed of the following members to be appointed by the City Mayor and whose terms of office shall be co-terminus with the term of the appointing authority, unless otherwise terminated by the latter earlier:

3.1	Chairman, SP Committee on Public Safety and Fire
3.2	Chairman, SP Committee on Health Services
3.3	Chairman, SP Committee on Education
3.4	City Health officer
3.5	Chairman, SP Committee on Sports, Youth Development, Juvenile Delinquency and Drug Addiction 
3.6	Four (4) representatives from the private and education sectors.

The Chairman shall be chosen from among the four (4) members representing the private/educational sector.

SECTION 4. Administrative Composition. Aside from the POSAP membership as enumerated in the preceding Section, the POSAP shall be administratively managed by the following responsible personnel:

4.1	An Executive Director who shall be designated by the City Mayor from among the existing personnel of the City government, and shall be tasked to perform the following duties:

4.1.1	Prepare the agenda of the meetings of the POSAP and to record the minutes of the same.

4.1.2	Submit quarterly report to the Chairman of POSAP.

4.1.3	Submit annual report to the POSAP members within two (2) months after the close of each calendar year, and

4.1.4	Perform such other duties and functions that maybe required of him or her from time to time;

4.2	Clerical  Staff. In order to complement the various operational and administrative needs of the POSAP, there shall be designated and/or assigned by the City Mayor sufficient clerical and utility personnel in the POSAP, the number of which shall be determined and requested by the Chairman.

SECTION 5. Remuneration/Compensation. The Chairman and the Members of the POSAP shall render voluntary service. As such, they shall not be entitled to honorarium or any form of remuneration and compensation, except, however, when they are authorized to travel outside the City, their travel expenses shall be chargeable against the appropriations of the Office. Such travel, however, should be connected and has relation to the purpose and intent of the POSAP.

SECTION 6. 	Meetings and Quorum. The members of the POSAP shall convene and meet at least twice a month or as the need arises. Notices must be served to the members at least one (1) day before the scheduled meeting.

The presence of five (5) of the members shall constitute a quorum; provided, however, that the presence of three (3) members, including the Chairman, shall likewise constitute a quorum for the transaction of business.

SECTION 7.	Appropriations. For purposes of this Ordinance, there shall be a continuing appropriation  of Five Hundred Thousand Pesos (P500,000.00) per annum for the operating expenses and maintenance costs of the POSAP.

SECTION 8. Separability Clause. Any provision or provisions of this Ordinance that maybe declared by a competent court as invalid or unconstitutional shall not adversely affect other provisions.

SECTION 9.	Effectivity. This Ordinance shall take effect immediately upon its approval.


ENACTED AND APPROVED by the 6th City Council of Pagadian during its 23rd Regular Session held on December 7, 1998 at the Sangguniang Panlungsod Session Hall.
