ORDINANCE NO: 1995-129 (Bill No. 64) "AN ORDINANCE PROVIDING RULES AND REGULATIONS GOVERNING VEHICULAR TRAFFIC IN THE CITY OF PAGADIAN AND CORRESPONDING PENALTIES FOR VIOLATION THEREOF" BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF THE CITY OF PAGADIAN THAT: ARTICLE I - TRAFFIC VIOLATIONS SECTION 1. The following acts or omissions in the operation of any motor vehicle and the use of thoroughfares are declared traffic violations: VIOLATIONS FINE IMPROPER USE OF MOTOR VEHICLES: 1. Driving without first securing proper license. P200.00 2. Failure to carry Driver's License. 50.00 3. Failure to sign Driver's License. 50.00 4. Driving while under the influence of liquor and/or prohibited drugs. 500.00 5. Allowing an unlicensed/improperly licensed person to drive. 200.00 6. Fake license. 500.00 7. Allowing another person to use his license. 150.00 8. Using a motor vehicle in the commission of crime. Revocation of license 9. Operating a motor vehicle without being accompanied by a licensed driver (SPR). 50.00 SECTION 2. TRAFFIC CITATION TICKETS. (a) Any person apprehended for violating any provision(s) of this Ordinance shall be issued a traffic citation ticket in the form prescribed for the purpose and to be issued by the apprehending officer of the Philippine National Police and/or any duly authorized personnel. (b) In the absence of the offending owner, operator or driver, the Traffic Citation Ticket shall placed conspicuously on the vehicle. (c) The provisions of the Traffic Citation Ticket shall be complied by the offender within the number of days prescribed therein. SECTION 3. ENFORCEMENT OF TRAFFIC RULES. The enforcement of rules and regulations related to the use of all streets, thoroughfares, alleys, bridges, sidewalks and other places intended for transportation and pedestrians shall be enforced by the Traffic Management Office of the City Government. SECTION 4. PAYMENT AND COLLECTION OF FINES. All fines for the first and second offenses as herein prescribed shall be paid to the City Treasurer only after completion of the seminars but not later than seven (7) days after apprehension. For the third offense, payment shall be within thirty (30) days from apprehensions. The confiscated driver's license and franchise shall be released and restored, as the case of a suspended franchise, to the owner/operator immediately after payment of the fines. SECTION 5. Traffic Citation Ticket shall be issued to the erring vehicle driver, owner or operator who will be cited for the first and second offenses. ARTICLE III - ADMINISTRATIVE PROVISIONS SECTION 1. Traffic Law Enforcers, Pollution Control Officers, Transportation Officers and other Officers from the National Government who have certain duties relating to traffic, emission control or motor vehicles and licensing of motor vehicles and drivers shall to consult the City Government on their plans, programs and operations and secure approval before implementation thereof from the Sangguniang Panlungsod pursuant to Sections 26, 27 & 458 (a) (5) (v) and(vi) of the Local Government Code of 1991. SECTION 2. All traffic signs, signals and road markings intended to inform drivers and regulate the use of streets, alleys, bridges and sidewalks before they are installed or removed shall be approved by the Sangguniang Panlungsod through the recommendation of the City Mayor. SECTION 3. CITY TRAFFIC MANAGEMENT OFFICE. A City Traffic Management Office shall be created through the enactment of a separate ordinance. The Civil Security Unit of the Office of the City Mayor and the Office of the City Engineer shall enforce traffic management in the city pending the enactment of the appropriate ordinance. ARTICLE IV - MISCELLANEOUS PROVISIONS SECTION 1. APPROPRIATION. The sum of Ten Thousand (P10,000.00) Pesos shall initially be allocated from Project No. 53515, Account No. 1011-1914-200 (20% Development Fund) for the initial printing of the Traffic Citation Tickets. Thereafter, the cost of the subsequent printings shall be charged to the accumulated of fines and penalties for traffic violations. SECTION 2. SEPARABILITY CLAUSE. If any provision or part of this Ordinance shall be declared unconstitutional or invalid, the same shall not affect the constitutionality or validity of the other provisions or parts thereof. SECTION 3. REPEALING CLAUSE. If any provision or part of any existing ordinance is not consistent with this Ordinance, the same is hereby repealed or modified accordingly. SECTION 4. EFFECTIVITY. This Ordinance shall take effect immediately upon its approval.
