ORDINANCE NO: 1994-122 (Bill No. 57) "AN ORDINANCE AMENDING SOME PROVISIONS OF CITY ORDINANCE NO. 78, S. 1992, OTHERWISE KNOWN AS "AN ORDINANCE ESTABLISHING GUIDELINES AND POLICIES IN THE CONDUCT AND OPERATION OF THE NEW AGORA IN THE CITY OF PAGADIAN, AND IMPOSING PENALTIES FOR VIOLATIONS THEREOF" BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF THE CITY OF PAGADIAN, THAT: SECTION 1. - There shall be added another paragraph on Section 21, Article III of City Ordinance No. 78, s. 1992 under the title "Restriction and Prohibitions" to be marked as paragraph "i" and which shall be read as follows: "(i) No person and/or stallholder shall be allowed to use or utilize any area or areas which are purportedly market corridors, pedestrian lanes, sidewalks, alleys, roads or streets, for the purpose of selling, displaying, and/or storing of merchandise and other commodities." SECTION 2. - Section 1, Article IV of City Ordinance No. 78, s. 1992, is hereby amended and shall be read as follows: "Unless otherwise provided and/or specified in any Article and/or Section of this Ordinance, neglect or failure of stallholders to comply with the provisions hereof shall be penalized as follows: a. For the First Offense, a fine of Five Hundred Pesos (P500.00) or Five (5) days imprisonment; b. For the Second Offense, a fine of One Thousand Pesos (P1,000.00) or one month (30 days) imprisonment; c. For the Third Offense, a fine of One Thousand Pesos (P1,000.00) or one month (30 days) imprisonment with revocation of business permit and license; d. Merchandise and Commodities referred to in Section 21, Article III of this Ordinance shall be confiscated or seized accordingly and to be turned over to the Office of the Market Superintendent for proper disposition." SECTION 3. - This Ordinance shall take effect immediately upon approval. ENACTED AND APPROVED by the Sangguniang Panlungsod on its 14th Regular Session held on April 4, 1994.
