"AN ORDINANCE REGULATING THE ESTABLISHMENTS AND OPERATIONS OF FOOD VENDORS AND HANDLERS IN THE CITY OF PAGADIAN, AND IMPOSING PENALTIES FOR VIOLATIONS THEREOF"

BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF THE CITY OF PAGADIAN IN SESSION ASSEMBLED:

ARTICLE I - PURPOSE

	SECTION 1. - This Ordinance is promulgated and enacted to protect and ensure the safety and health of the consuming public particularly students and school from harmful diseases brought about by food contamination.

ARTICLE II - DEFINITION

SECTION 2. - As used in this Ordinance, the following shall refer to mean:

Food - refers to edible/drinkable goods sold for consumption.
Food Handler - refers to one who handles food for sale.
Ambulant Food Vendor - refers to one who sells food from place to place.
Stationary Food Vendor - refers to one who sells food at a more or less permanent place of business.

ARTICLE III - PROVISIONS

SECTION 3. - For purposes of this Ordinance, the following regulations are hereby promulgated as integral provisions hereof and shall be the basis for implementation of the same.
SECTION 4. - Any person or persons found violating any provision of this Ordinance shall for every violation pay a fine of not less than One Hundred (P100.00) Pesos but not more than Five Hundred (P500.00) Pesos or face imprisonment of not less than two (2) days but not more than five (5) days or both depending upon the discretion of the Court.

ARTICLE V - SEPARABILITY CLAUSE
 
SECTION 5. - In case any provision of this Ordinance or parts thereof shall be declared invalid or unconstitutional the same shall not affect the validity of other provisions or parts of this Ordinance.

ARTICLE VI - REPEALING CLAUSE

SECTION 6. - Ordinances which are inconsistent with the provisions of this Ordinance are hereby repealed, or amended accordingly.

ARTICLE VII - EFFECTIVITY

SECTION 7. - This Ordinance shall take effect immediately upon its approval.
