ORDINANCE NO: 1993-113 (Bill No. 44) "AN ORDINANCE REQUIRING STALL/STAND/SPACE APPLICANTS/OCCUPANTS IN ALL CITY GOVERNMENT OWNED OR OPERATED BUILDINGS UNDER THE DIRECT CONTROL AND SUPERVISION OF THE ECONOMIC ENTERPRISE MANAGEMENT OFFICE TO PAY AN ADVANCE RENT AS A GUARANTEE OF GOOD FAITH THE AMOUNT EQUIVALENT TO THREE (3) MONTHS RENTAL OF THE STALL/STAND/SPACE OCCUPIED OR APPLIED" BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN CITY THAT: SECTION 1. - As a guarantee of good faith, all stall/stand/space holders/occupants in all city government owned or operated buildings under the direct control and supervision of the Economic Enterprise Management Office shall be required to pay in advance to the City Treasurer an amount equivalent to three (3) months rent for their stall/stand/space held, occupied or applied for in the manner herein provided. New applicants shall pay the required amount in full on or before the signing of the lease contract. Existing stallholders and occupants shall pay the required amount within 20 calendar days after this ordinance is approved. SECTION 2. - The Guarantee Deposit paid by stall/stand/space holders/occupants in the new public market as provided in City Ordinance No. 78, s. 1992 shall be converted and reduced to the required advance rental with the balance refundable upon demand. SECTION 3. - At the recommendation of the Department Head, Economic Enterprise Management Office and approval of the City Mayor, all infractions or culpable violations against any provision of ordinances pertaining to market operations, shall forfeit such advance rent in favor of the City Government and the subsequent closure of the stall of the erring lessee. SECTION 4. - This Ordinance repeals, amends or modifies the provisions of all such other ordinances, inconsistent hereto and Section 5 (b) of City Ordinance No. 78, s. 1992. SECTION 5. - This Ordinance shall take effect immediately upon its approval. ENACTED AND APPROVED by the Sangguniang Panlungsod on its 43rd Regular Session held on October 25, 1993.
