ORDINANCE NO: 1993-112 (Bill No. 40) "AN ORDINANCE PROHIBITING THE PICKING OF FLOWERS AND CUTTING OF STEMS AND BRANCHES OF ORNAMENTAL PLANTS WITHIN PUBLIC PLAZAS, STREET CENTER ISLANDS AND SUCH OTHER PUBLIC GARDENS AND LANDSCAPES AND IMPOSING PENALTIES FOR VIOLATIONS THEREOF" BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN CITY IN SESSION ASSEMBLED THAT: SECTION 1. - Pursuant to the provisions of R.A. 7160, otherwise known as the Local Government Code of 1991, this Ordinance is hereby promulgated and enacted for the purpose of preserving and maintaining the beauty introduced by the government for the appreciation of its inhabitants. SECTION 2. - All public plazas, city street center islands, and such other public places in the City where ornamental plants, gardens and landscapes are maintained, are hereby protected by this Ordinance. SECTION 3. - For the purpose of this Ordinance, the picking and/or cutting of stems and branches of plants in the places mentioned above are strictly prohibited, except when done by person(s) in-charge who may prune or trim the plants for the purpose of maintenance. SECTION 4. - Persons violating the provision of the preceding section shall be fined with not less than One Hundred (P100.00) Pesos but not more than Five Hundred (P500.00) Pesos or face imprisonment of not less than ten (10) days but not more than thirty (30) days or both, such fine and imprisonment at the discretion of the Court. SECTION 5. - This Ordinance repeals and/or modifies accordingly all previous similar measures inconsistent hereto. SECTION 6. - This Ordinance shall take effect immediately upon its approval.
