ORDINANCE NO: 1993-107 (Bill No. 15) "AN ORDINANCE PROVIDING CHARGES AND FEES FOR THE PROCESSING AND APPROVAL OF SUBDIVISION/CONDOMINIUM PLANS FOR RESIDENTIAL, COMMERCIAL, OR INDUSTRIAL AND OTHER DEVELOPMENT PURPOSE AND IMPOSING PENALTY FOR VIOLATION THEREOF" BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN CITY THAT: ARTICLE I - TITLE This measure is pursuant to Section 458 (a), (2), (x) of Republic Act No. 7160, otherwise known as the Local Government Code of 1991 and it shall be known as SUBDIVISION PLAN PROCESSING AND APPROVAL ORDINANCE of Pagadian City. ARTICLE II - COVERAGE SECTION 1. - Any person, whether natural or juridical, partnership or corporation must seek approval of subdivision plans for residential, commercial, or industrial and other development purposes with the Sangguniang Panlungsod and they shall be liable to pay subdivision plan processing and approval fees and other charges. ARTICLE III - PROCESSING SECTION 1. - It shall be the duty of the City Planning and Development Coordinator/Deputized Zoning Administrator to receive applications for approval of subdivision plans, process, evaluate and recommend approval of the same to the Sangguniang Panlungsod. He shall see to it that the subdivision plans must conform with the rules, regulations and standards promulgate by the Housing and Land Use Regulatory Board implementing Presidential Decree Nos. 957, 1216, 1344, Batas Pambansa 220, Republic Act No. 7279 and other related laws, and with the existing land use and zoning plan of the City of Pagadian. ARTICLE IV - SCHEDULE OF FEES AND CHARGES SECTION 1. - There shall be collected the following specific rates of fees and charges for the processing and approval of subdivision plans for residential, commercial or industrial, and other development purposes within the City of Pagadian which will be paid to the Office of the City Treasurer. For every additional hectare or a fraction thereof 12.10 Final Processing Fees Subdivision having a density of 66 to 100 families/lots gross hectares, per hectare or a fraction thereof 181.50 Subdivision having a density of 21 to 65 families/lots gross hectare, per hectare or a fraction thereof 242.00 Subdivision having a density of 20 and below families/lots gross hectare, per hectare or a fraction thereof 363.00 Additional fee on floor area of houses/building sold with the lot, per square meter 0.121 Inspection Fees for Final Approval Subdivision having a density of 66 to 100 families/lots gross hectares, per hectare or a fraction thereof 110.00 Subdivision having a density of 21 to 65 families/lots gross hectare, per hectare or a fraction thereof 165.00 Subdivision having a density of 20 and below families/lots gross hectare, per hectare or a fraction thereof 220.00 Alteration of Plans Fees Same as Final Processing Fees Approval of Condominium Plan 1. For the first five (5) hectares 60.50 b. For every additional hectare or a fraction thereof 6.05 Final Approval Fee a. Per hectare or a fraction thereof 181.50 Alteration of Plan Fee Same as Final Processing Fee and shall cover the affected portions of the subdivision, pro rated against the fees of the total area. Fees on Memorial Park/Cemetery Plan Approval of Memorial Park/Cemetery Plan a. Preliminary Processing Fee/Locational Clearance Fee for the first One (1) hectare 60.50 For every additional hectare or a fraction thereof 12.10 b. Final Processing Fee, per square meter 0.66 c. Alteration of Plans Fees 0.66 per square meter but covers only affected portions of plans subject to alterations. d. Inspection Fee per hectare or a fraction thereof 24.20 For Economic and Socialized Housing and Batas Pambansa Blg. 220, Fees under P.D. 957, 1096, 1105 1. Plan/s Approval and Development Permit, per hectare 181.50 2. Building Permit, per square meter 1.21 SECTION 1. - Any ordinance or part thereof inconsistent with this Ordinance is hereby repealed or modified. ARTICLE VII - SEPARABILITY CLAUSE SECTION 1. - If any part or provision of this Ordinance shall be held unconstitutional or invalid, other parts or provisions which are not affected thereby shall continue to be in full force and effect. ARTICLE VIII - EFFECTIVITY SECTION 1. - This Ordinance shall take effect upon its approval. ENACTED AND APPROVED by the Sangguniang Panlungsod of Pagadian City during its 24th Regular Session on June 14, 1993.
