"AN ORDINANCE PROHIBITING SOLICITATION OF ADVERTISEMENT FOR SOUVENIR PROGRAM FOR FIESTA AND OTHER OCCASIONS FROM GOVERNMENT AND PRIVATE OFFICES OR ESTABLISHMENTS, GOVERNMENT OFFICIALS, EMPLOYEES AND THE PUBLIC WITHOUT A PERMIT FROM THE OFFICE OF THE CITY MAYOR AND IMPOSING PENALTIES FOR VIOLATION THEREOF"

BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN CITY THAT:

ARTICLE I - PURPOSE

	This Ordinance is enacted to protect the government and private offices or establishments, government officials and employees and the public from unauthorized solicitors of advertisement for souvenir program for fiesta and other occasions.

ARTICLE II - DEFINITION

	For purpose of this Ordinance, the following terms are defined:

	SOLICIT - ask for contribution.

SOLICITOR - a person or office, organization, association or corporation who seeks or asks for contribution.

ADVERTISEMENT - a printed notice or statement paid for.

SOUVENIR PROGRAM - printed list of schedules of ceremonies, entertainment and other activities.

FIESTA - a religious and civic celebration or festival.

ANOTHER OFFICE - any building or rooms or series of rooms in which the affairs of a business, professional person, branch or agency of the government are carried on or services rendered.

OTHER OCCASIONS - any other celebration or activity.

ARTICLE III - REGULATIONS

	SECTION 1. - Any person, office, organization, corporation or association desiring to solicit for advertisement for souvenir program for fiesta or other occasions from government or other offices or establishments, government officials, employees and the public, shall secure first a permit to solicit from the Office of the City Mayor.

	SECTION 2. - The solicitor shall present a written authority to solicit from the head of the office, organization, corporation or association, and stating the purpose of such solicitation.

	SECTION 3. - Newspapers and magazines with regular publications are exempted from this Ordinance.

ARTICLE IV - PENALTIES

	SECTION 1. - Any person found guilty violating Section 1 and 2 of Article III of this Ordinance shall be fined not less than One Hundred (P100.00) Pesos but not more than Five Hundred (P500.00) Pesos payable to the City Government or suffer an imprisonment of not less than two (2) days not more than five (5) days.

ARTICLE V - SEPARABILITY CLAUSE

	In case any provision or part of this Ordinance be declared invalid or unconstitutional the same shall not affect the validity of the other provisions or part of this Ordinance.

ARTICLE VI - EFFECTIVITY

	This Ordinance shall take effect fifteen (15) days after its publication in any of the local newspapers.

ENACTED AND APPROVED by the Sangguniang Panlungsod of Pagadian City during its 9th Regular Session held on March 5, 1991 at the SP Session Hall.
