ORDINANCE NO: 1990-71 "AN ORDINANCE AMENDING AND PROVIDING INSERTION OF ADDITIONAL PENAL PROVISION TO SECTION 3 OF ORDINANCE NO. 3, S. 1973 ENTITLED: "AN ORDINANCE PROHIBITING PERSON/S FROM LETTING LOOSE OR TYING THEIR ANIMALS IN PUBLIC PREMISES AND OTHER PLACES IN THE CITY OF PAGADIAN AND IMPOSING PENALTIES FOR VIOLATION THEREOF" BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN CITY THAT: SECTION 1. - Section 3 of Ordinance No. 3, s. 1973, is hereby amended to be read as follows: "Section 3 - Any person who violates the provision of this Ordinance, in addition to the civil liabilities that may be imposed on him, he shall be fined not more than One Hundred (P100.00) Pesos or be imprisoned for not more than five (5) days or both such fine and imprisonment in the discretion of the Court." SECTION 2. - Astray animals caught and/or involved in the violation of this Ordinance shall be held and impounded under the responsibility of the Barangay Captain of person/s designated by him and shall only be released after the owner shall have settled the fine, determined cost of damage/s and payment of an impoundment fee to the Barangay Treasurer in the amount of Twenty (P20.00) Pesos per day of impoundment and same animal/s shall be subject to our existing law for their disposition in case of the failure of the owner to claim and/or settle the above-mentioned obligations. SECTION 3. - Any ordinance or provision hereof inconsistent with the above amendment and insertion is hereby repealed and amended. SECTION 4. - This Ordinance shall take effect upon its approval.
