ORDINANCE NO: 1990-70 "AN ORDINANCE DESIGNATING EASTERN PORTION OF THE OLD PUBLIC MARKET ALONG BONIFACIO STREET BOUNDED BY JAMISOLA STREET AND RIZAL AVENUE IN THE CITY OF PAGADIAN AS SITE FOR THE NIGHT MARKET AND REGULATING ITS OPERATIONS AND PROVIDING PENALTIES FOR VIOLATION THEREOF" BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN CITY THAT: SECTION 1. - PURPOSE - This Ordinance is designed to centralize the operation of barbeque, carenderia and cafeteria businesses operating nightly as well as fruit stands for the convenience of the public. SECTION 2. - The operation of the night market: The night market shall operate from six o'clock (6:00 p.m.) in the evening to six o'clock (6:00 a.m.) in the morning. Permits and/or licenses to operate and occupy stalls/spaces in the night market area shall be limited to and/or be exclusive for barbeque, carenderia and/or cafeteria business. All barbeque, carenderia and/or cafeteria business operating in and around the city having no legitimate areas for operation at the time of the approval of this Ordinance shall be relocated in the night market area. SECTION 3. - Upon the approval of this Ordinance and henceforth, no business of any kind shall be tolerated within the sidewalks, alleys or road right-of-ways anytime of the day or night. SECTION 4. - Aside from the confiscation of all paraphernalias used in the business, violation of any provision of this Ordinance shall subject the offender to the following penalties, viz: First Offense - penalty of Two Hundred (P200.00) Pesos or an imprisonment of two (2) weeks to one (1) month or both such fine and imprisonment at the discretion of the Court. Second and succeeding offenses - penalty of Five Hundred (P500.00) Pesos and/or an imprisonment of thirty (30) days to sixty (60) days or both at the discretion of the Court. SECTION 5. - This Ordinance shall take effect immediately upon its approval. ENACTED AND APPROVED by the Sangguniang Panlungsod of Pagadian City on June 18, 1990, during its 23rd Regular Session held at the SP Session Hall.
