ORDINANCE NO: 1990-68

"AN ORDINANCE PRESCRIBING FEES FOR THE RESTORATION OF GRAVEL, ASPHALTED, AND CEMENTED ROADS, STREETS/ALLEYS"

BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN CITY THAT:

ARTICLE I - PURPOSE

	This Ordinance, aims to prescribe fees for the restoration of all barangay, city, and national roads, streets and alleys within the territorial jurisdiction of Pagadian City.

ARTICLE II - DEFINITION

Road - a public open way for the passage of vehicles, persons, and animals.
Street - a public way or thoroughfare including the sidewalks located on both sides.

ARTICLE III - REGULATIONS

		
SECTION 1. -  No person, group of persons, natural or juridical, government and semi-government, shall be allowed and/or permitted to excavate road/s and street/s for establishing water line connection purposes and for any purpose whatsoever unless he or they shall pay a restoration fee in the amount of:

1. Cemented Road		- P550.00/square meter
2. Asphalted Road		- P100.00/square meter
3. Gravelled Road		- P  80.00/square meter

SECTION 2. - After paying such fee, a Mayor's Permit shall be issued to the person, group of persons, natural or juridical, government or semi-government entity, doing such excavation.

ARTICLE IV - SEPARABILITY CLAUSE

	Any provision/part or section of this Ordinance declared invalid or unconstitutional shall not affect the validity of the other parts, provisions, or sections of this Ordinance.

ARTICLE V - EFFECTIVITY 

	This Ordinance shall take effect immediately upon its approval.
ENACTED AND APPROVED by the Sangguniang Panlungsod of Pagadian City during its 16th Regular Session held on April 30, 1990, at the SP Session Hall.
