ORDINANCE NO: 1990-66

"AN ORDINANCE REGULATING THE PARKING OF VEHICLES IN SOME STREETS/AVENUE IN PAGADIAN CITY AND IMPOSING PENALTIES FOR VIOLATION THEREOF"

BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN CITY THAT:

ARTICLE I - PURPOSE

	This Ordinance is aimed to minimize traffic hazards and jams in the major streets and avenue traversing the busy commercial centers of Pagadian City.

ARTICLE II - DEFINITION OF TERMS

	For purposes of this Ordinance, the following terms are defined as follows:

Vehicles - Any conveyance or carrying passengers, goods, equipments, etc. usually moving on wheels or runners having a gross weight of four thousand (4,000) kilos and up as a cars, jeeps, trucks, vans, etc.
Park/Parking - To put up or leave a vehicle for a time at a certain location.

ARTICLE III - REGULATIONS

SECTION 1. - No person shall be allowed to park his vehicle on the following street or portion thereof and avenue or portion thereof as hereunder defined, except when loading and unloading passengers and cargoes:

PLATOON URRO/C. ARELLANO STREET - That portion located between F. Consolacion and Juan Alano Streets;
BENIGNO AQUINO STREET/BALTAZAR STREET - That portion located between Marcelo Dablo, Sr. and Platoon Urro Streets;
RAMON MAGSAYSAY AVENUE - That portion located between Sta. Lucia Elementary School Site and Kawit Bridge at San Pedro District;
FAUSTINO JAMISOLA, SR. STREET - That portion located between Araullo and Juan Alano Streets;
JUAN ALANO STREET - That portion located between Marcelo Dablo, Sr. and Platoon Urro Streets;
MARCELO DABLO, SR. STREET - That portion located between Araullo and Juan Alano Streets;
ANDRES BONIFACIO STREET - That portion located between Marcelo Dablo, Sr. and Vincenzo Sagun Streets;
VINCENZO SAGUN STREET - That portion located between Araullo and Juan Alano Streets;
JOSE SAMSON STREET - That portion located between Araullo and Alano Streets;
MARIANO CABRERA, SR. STREET - That portion located between Juan Alano and Araullo Streets;
JOSE P. RIZAL AVENUE - That portions located between Dr. B. Sabellano Street and Balangasan concrete bridge;
F.S. PAJARES AVENUE - That portion located between Platoon Urro Street and PPA Zone.

ARTICLE IV - PENALTIES

	SECTION 1. - Any person violating the provision/s of this Ordinance shall be penalized with an administrative fine of Five Hundred (P500.00) Pesos but not more than One Thousand (P1,000.00) Pesos or an imprisonment of not less than six (6) months but not more than one (1) year or both such fine and imprisonment at the discretion of the Court.

	SECTION 2. - Any vehicle subject to this Ordinance caught parking in any of the prohibited places as herein defined may be taken by the Police for impoundment until the prescribed fine shall be settled; however, in case the subject vehicle is abandon by its driver and the same is towed to the Police Station Compound and the owner shall pay a towing service fee in the amount of Three Hundred (P300.00) Pesos and the amount of Fifty (P50.00) Pesos per day shall be paid as an impoundment service fee.

ARTICLE V - REPEALING CLAUSE

	Any provision or part thereof of any previous ordinance/s in conflict or inconsistent, hereof, are hereby, declared repealed.

ARTICLE VI - EFFECTIVITY

	This Ordinance shall take effect immediately upon its approval.
     
ENACTED AND APPROVED by the Sangguniang Panlungsod of Pagadian City on March 19, 1990, in its 11th Regular Session, at the SP Session Hall.
