"AN ORDINANCE DESIGNATING SPECIFIC AREAS ALONG RIZAL AVENUE AS LOADING/UNLOADING POINTS FOR PASSENGER BUSES AND PROVIDING PENALTIES FOR VIOLATION THEREOF"


BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN CITY:

ARTICLE I. - Explanation of Terms - As used in this Ordinance the terms loading and unloading points are certain specific areas where passengers are allowed to embark or disembark from passenger buses. 

ARTICLE II. - Except on areas or points specified in the subsequent sections of this Ordinance passenger buses are not allowed to load/unload passenger from Balangasan bridge (near Purok Acacia) to the Philippine Constabulary Headquarters at Camp Abelon, this City. 

ARTICLE III. - There is hereby provided along Rizal Avenue at junction B. Aquino, Jr. and Araullo Streets ten (10) meters from the corner of B. Aquino Street on both sides of the Avenue, an area for loading and unloading of passengers.

ARTICLE IV. - There is hereby provided along Rizal Avenue at junction Sabado and Roxas Streets ten (10) meters from the corner of Sabado Street on both side of the Avenue, an area for loading and unloading of passengers.

ARTICLE V. - The loading/unloading areas as provided for in this Ordinance shall be four (4) meters wide and twenty (20) meters long and shall be distinctively marked. Proper traffic signs shall be installed for the purpose.

ARTICLE VI. - Duration of stops in the loading/unloading points designated in the preceding sections by passenger buses shall be limited to a maximum of ten (10) minutes.

ARTICLE VII. - All buses passing through Pagadian or whose final destination is Pagadian should allow their passengers to embark or disembark in the designated bus stops.

ARTICLE VIII. - For violation of any provision of this Ordinance, the offending driver or operator shall be made to pay a fine of One Hundred (P100.00) Pesos. Should such offending driver/operator be unable to pay a fine called for herein, the license and registration of the subject vehicle shall be confiscated subject for return until such fine has been properly settled.

ARTICLE IX. - Repealing Clause: Any previous ordinance or part thereof inconsistent hereof is hereby declared repealed or modified accordingly.

ARTICLE X. - Separability Clause: Any provision/part or section of this Ordinance declared invalid or unconstitutional shall not affect the validity of the other parts, provisions, or sections of this Ordinance.

ARTICLE XI. - Effectivity Clause: This Ordinance shall take effect ten (10) days after it has been published in a local paper of wide circulation.

ENACTED AND APPROVED by the Sangguniang Panlungsod of Pagadian City during its 3rd Special Session held on September 15, 1989, at the Sangguniang Panlungsod Session Hall.
