"AN ORDINANCE REGULATING VEHICULAR TRAFFIC IN THE CITY OF PAGADIAN"


BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN CITY:

ARTICLE 1 - This Ordinance shall be known as the Traffic Regulation Ordinance of Pagadian of 1989.

ARTICLE 2 - This Ordinance shall be for the purpose of obtaining orderly traffic flow in the city and servicing the transportation needs of the city. 

ARTICLE 3 - Jeepney Routes, Jeepney Unloading and Loading points, and terminal for jeepneys plying the suburbs of Pagadian City;

	SECTION 1. - There shall be established Jeepney Unloading and Loading points each measuring ten (10) meters in length and three (3) meters in width;

	SECTION 2. - There shall be no loading nor unloading nor parking in these areas for all vehicles except public utility jeepneys which may load and unload at these points in the following places, to wit:

Rizal Avenue, between Sabado and Alano Streets, both sides ten meters;
Pajares Avenue, between Rizal Avenue and Jamisola Street, both sides, ten (10)  meters from Jamisola Street;
Rizal Avenue, between Pajares Avenue and Bonifacio Street, both sides ten (10) meters from Bonifacio Street, both sides;
Pajares Avenue, between Magsaysay Avenue and Dablo Street, bot sides ten (10) meters from Magsaysay Avenue;
Pajares Avenue between Dablo Street, and Wharf Area both sides ten (10) meters from Dablo Street;
Pajares Avenue, between Cabrera Street and Rizal Avenue, both sides, ten (10) meters from Rizal Avenue;
Rizal Avenue, between Duterte and Zulueta Street, both sides, twenty (20) meters from Duterte Street;
Rizal Avenue, between Aquino and Araullo Streets, both sides, twenty (20) meters from Araullo Street.

SECTION 3. - There shall be established a jeepney terminal for jeepneys plying the barangays of Pagadian city solely at Dablo Street corner Pajares Avenue both sides.

SECTION 4. - There shall be established different jeepney routes within the City to ease the transportation problem:

The first jeepney route shall start at Dablo Street corner Pajares Avenue. It shall proceed northward along F.S. Pajares Avenue, then turn right to Rizal Avenue then turn left to Paglaum then to Zamboanga del Sur National High School then to Broca Street then turn left to Roxas Street then turn right to Arellano Street then turn left to Pajares Avenue then turn right to Rizal Avenue then left to Fatima Village Subdivision Road then to Dumagoc then left to Boulevard then left to Duterte Street then right to Magsaysay Street then right to Pajares Avenue then turn at the Wharf area then back to the starting point.
The second jeepney route shall start at Dablo Street corner F.S. Pajares Avenue. It shall proceed westward along Dablo Street, then to Boulevard then to Dumagoc then right to Ballesteros then to Monsignor then turn right to Rizal Avenue then left to Aquino Street, then right to Arellano Street then right to Paglaum-I then to Paglaum-2 then right to Rizal Avenue then left to Bonifacio Street then right to Dablo Street.
From 6:30 a.m. to 8:00 a.m. and 12:30 p.m. to 1:30 p.m. jeepneys from Ballesteros Road shall pass the Capitol area by taking a left turn to Consolacion Street then right to Arellano Street then right to R.T. Lim Street then left to Rizal Avenue then onwards.
From 11:30 a.m. to 12:30 p.m. and 4:00 p.m. to 5:30 p.m. jeepneys going to Ballesteros Road shall pass the Capitol area by taking a right turn to R.T. Lim Street then left to Arellano Street then left to Consolacion Street then right to Rizal Avenue. 
The third jeepney route shall start at Dablo Street corner F.S. Pajares Avenue and proceed east to Dablo Street then left to Bonifacio Street then right to Magsaysay Avenue then left to Sabellano Street then left to Rizal Avenue then right to Allano Street then left to Arellano Street then right to F.S. Pajares Avenue then left to Mercedes Street then left to PADAP Road then right to Arellano Street then right to Consolacion Street then left to Mercedes Street then left to Banale Road then to Consolacion Street then left to Rizal Avenue then right to Aquino Street then left to Magsaysay Avenue then right to F.S. Pajares Avenue then turn at the PPA gate then back to the starting point.
The fourth jeepney route shall start at Dablo Street corner F.S. Pajares Avenue then proceed to Dablo Street Boulevard then right to Araullo Street then left to Rizal Avenue then right to Consolacion Street then left to Mercedes Street then left to Banale Road then left to Arellano Street then left to Mercedes Street then left to PADAP Road then right to Mercedes Street then right to F.S. Pajares Avenue then left to Arellano Street then right to Bana Street then right to Sagun Street, then left to Roxas Street then to Fernan Street then right to Magsaysay Street then right to river control then right to San Pedro Market then to unnamed Street then to Dablo Street then to port area then turn to starting point.
The fifth jeepney route shall start from the bridge of Tawagan Sur then proceed south along the National Highway/Rizal Avenue then take a left turn to Alano Street then right to Magsaysay Avenue then left to Pajares Avenue then right to Dablo Street the right to Araullo Street then left to Rizal Avenue then turn at Pagadian-Dumalinao boundary then proceed back to Rizal Avenue then right turn at Araullo Street then left to Magsaysay Street then right to Bonifacio Street then right to Rizal Avenue then to bridge at Tawagan Sur/Labangan boundary.
Jeepneys coming from Dao and beyond shall turn left to Arellano Street then turn right to F.S. Pajares Avenue then turn left to Dablo Street and then park at Dablo Street. Jeepneys proceeding to Dao and beyond shall take F.S. Pajares Avenue then left to Arellano Street then right to PADAP road proceed to its destination.
Jeepneys coming from Dumalinao and other western municipalities of the Province of Zamboanga del Sur shall upon entering the city take a right turn to Araullo Street then left turn to Magsaysay Street then right to Jamisola Street then left to Bonifacio Street then proceed to their respective jeepneys terminals.
Jeepneys from Labangan and other eastern municipalities of the Province of Zamboanga del Sur shall follow Rizal Avenue upon entering the City proper then take a left turn to Araullo Street then left to Magsaysay Street then left to Pajares Avenue then right to Jamisola Street then left to Bonifacio Street then proceed to their respective jeepneys terminals.

ARTICLE IV. - Regulations for big buses, trucks and trailers.

SECTION 1. - As used in this Ordinance big buses and trucks are those vehicles whose gross vehicle weight equals or is above 5,000 kilograms.

SECTION 2. - Big buses and trucks are prohibited from 6:00 a.m. to 6:00 p.m. to park at the following avenues.

Pajares Avenue from Cabrera Street to PPA Gate, both sides.
Rizal Avenue from Alano Street to Araullo Street, both sides.

SECTION 3. - Big buses and trucks are prohibited from entering the Paglaum 1 and 2 road.

SECTION 4. - All buses coming from the north with the final destination as Pagadian City for the day shall arriving after 5:00 p.m. and before 6:00 p.m. proceed to Rizal Avenue until the bus stop between Sabado and Roxas Streets. Buses shall then take a right turn to Sabado Street then take a right turn to Cabrera Street then proceed to their respective bus terminals.

ARTICLE V. - Tricycle Loading/Unloading Areas.

SECTION 1. - Except on areas specified in the succeeding sections of this Ordinance, motorized passenger tricyles are not allowed to load or unload passengers and/or cargoes on the following locations along Rizal Avenue and F.S. Pajares Avenue, to wit:

Rizal Avenue: 
1. Southern Lane	- Araullo Street corner to Alano Street corner.
2. Northern Lane		- Roxas Street corner to B.S. Aquino Street corner.
   
F.S. Pajares Avenue:
1. Western Lane		- Cabrera Street corner to Dablo Street corner.   
2. Western Lane		- Dablo Street corner to Rizal Avenue corner.

	SECTION 2. - The following areas along the portions of Rizal Avenue and F.S. Pajares Avenue specified in Section 1 hereof are designated as loading and unloading points for motorized passenger tricycle, to wit:

Rizal Avenue Southern Lane:
Twenty (20) meters from the corner of Araullo Street
Ten (10) meters before F.S. Pajares corner
Ten (10) meters after F.S. Pajares corner
Ten (10) meters after A. Bonifacio Street corner
 Rizal Avenue Northern Lane:
Twenty (20) meters before Sabado Street corner
Ten (10) meter before A. Bonifacio Street corner
Ten (10) meters before F.S. Pajares Avenue corner
F.S. Pajares Avenue Western Lane:
Ten (10) meters before Rizal Avenue corner
Ten (10) meters after Rizal Avenue corner
Ten (10) meters before F. Jamisola Street corner
Ten (10) meters before Magsaysay Street corner
Ten (10) meters before Dablo Street corner
F.S. Pajares Avenue Eastern Lane:
Thirty (30) meters from Dablo Street corner
Ten (10) meters after R. Magsaysay Street corner
Ten (10) meters after F. Jamisola Street corner

SECTION 3.	 - The loading/unloading areas for motorized passenger tricycles, as provided for in this Ordinance, shall be fifteen (15) meters long. Distinctive markings on the lane shall be made in proper traffic signs installed for the purpose.

ARTICLE VI. - Regulations for City Tricycle Jeepney Bus Drivers and Conductors.

SECTION 1. - All drivers of public utility vehicles including tricycles, operating within and through the City of Pagadian shall post prominently inside the vehicles they are driving an ID as prescribed by the City Government. Such ID card shall be plastic laminated.

SECTION 2. - The size of the ID cards shall be six (6) inches in height by eight (8) inches in width. The ID card shall contain a 2x2 unretouched picture of the driver. The driver's full name shall be printed with the surname first, then the given name then the middle initial. The lettering shall be modern sans serif and the height of the letter shall be one (1) inch and the width of the stroke shall be 1/8 of an inch. The driver's full address shall be printed also in modern sans serif with the height of the letters ? inch with the stroke width 1/16 of an inch. The ID shall also contain the signature of the Mayor of Pagadian City and shall be sealed with the seal of the City of Pagadian. The cost of one card shall be Ten (P10.00) Pesos and shall be renewable every four (4) years.

SECTION 3. - All passengers ticket sellers, passenger ticket promoters, dispatchers, barkers, and conductors shall wear IDs posted at their left breast. Such IDs shall be two (2) inches in width and three (3) inches in length and shall contain the name of the bearer, his/her address, the type of occupation he or she is engage in, the name of the employer and address of the employer. This ID shall be countersigned by the employer and the City Mayor. The fee for the issuance of the ID shall be Five (P5.00) Pesos. This card shall be renewable every four (4) years.

SECTION 4. - All passenger ticket sellers, passenger ticket promoters, dispatchers, barkers and conductors shall wear T-shirts or polo shirts with their name and occupation printed prominently at the back of the T-shirt and polo shirt, and the name of their employer printed in front.

ARTICLE VII. - Tricycle Bus and Jeepney Requirements.

SECTION 1. - All tricycle shall have the full name and addresses of their owners/operators printed prominently on the right side of their vehicles.

SECTION 2. - All tricycle-for-hire when intended by the driver/operator to be not for hire shall post a sign with the word CARBARN printed in red over a blue background which is to be placed prominently outside front of the tricycle cab.

SECTION 3. - Tricycles Operators shall post the approved fare matrix in the inside front of the tricycles.

SECTION 4. - Buses and jeepneys shall post an approved fare matrix within their vehicles.

SECTION 5. - Bus and jeepney terminals shall post a fare rate and distance matrix in their respective terminals for the routes they cover.

ARTICLE VIII. - Fares for Tricycles.

SECTION 1. - There shall be established a tricycle fare rate for the City of Pagadian.

SECTION 2. - The proposed fare rate shall be One (P1.00) Peso for the first kilometer and an additional P0.35 for every succeeding kilometer.

SECTION 3.  - Students shall pay only seventy-five (75%) percent of the approved fare rate.

SECTION 4. - Distance matrix and a fare matrix for common destinations within the City shall be made by the City and attached to this Ordinance for reference.

SECTION 5. - The approved fare rate and fare matrix shall be posted in these places:
Bus Terminals
Jeepney Terminals
Shopping Center
Wharf Area
City Hall
Provincial Capitol
DPWH

ARTICLE IX. - Penalties.

SECTION 1. - Any driver who violates any provisions of this Ordinance shall pay a fine of Fifty (P50.00) Pesos and have his driver's license and ID confiscated and shall not be allowed to drive within the City for three (3) days.

SECTION 2. - Any driver who fails to procure his ID and drives within the City shall pay  fine of One Hundred (P100.00) Pesos and he shall be suspended from driving in the City for one (1) week.

SECTION 3. - Any conductor, passenger ticket seller, passenger ticket promoters, barkers or dispatchers, who fails to wear the prescribed ID or clothing uniform shall pay a fine of One Hundred (P100.00) Pesos and suspended for his occupation for three (3) days.

SECTION 4. - Any person who violates any Section of this Ordinance three (3) times in one year period shall pay a fine double to the prescribed fine.

SECTION 5. - Any person who shall vandalize any fare matrix shall pay a fine of Fifty (P50.00) Pesos and shall be imprisoned for seven (7) days.

SECTION 6. - Any bus, jeepney operator who fails to post a distance and fare matrix within his or her vehicle shall pay a fine payable to the City Government of Five Hundred (P500.00) Pesos.

SECTION 7. - Any bus terminal manager or operator offense to post a distance and fare matrix within his terminal shall pay a fine of Five Hundred (P500.00) Pesos and be imprisoned for seven (7) days. The size of the letter and numbers shall at least 1 ? inch tall and ? inch in thickness.

ARTICLE X. - Separability Clause.

In case of any provision or part of this Ordinance be declared invalid or unconstitutional, the same shall not affect the validity of the other provisions or parts of this Ordinance.

ARTICLE XI. - Repealing Clause.

All previous ordinance or parts thereof which are inconsistent with the provisions of this Ordinance are hereby repealed and/or modified.

ARTICLE XII. - Effectivity Clause.

This Ordinance shall be effective ten (10) days after publication in a refutable newspaper of a weekly circulation within the City of Pagadian. The Ordinance shall also be posted in the different Barangay Halls of the fourteen (14) Urban District of the City and the City Hall.
