ORDINANCE NO: 1989-60 "AN ORDINANCE REGULATING THE ESTABLISHMENT/OPERATION OF BOARDING HOUSES, LODGING HOUSES, TENEMENT HOUSES, AND DORMITORIES IN THE CITY OF PAGADIAN AND IMPOSING PENALTIES FOR VIOLATION THEREOF" BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN CITY THAT: ARTICLE 1 - PURPOSE. This Ordinance is purposely enacted to protect the health and welfare of the citizens - most particularly the students - who are availing of accommodations in boarding houses, lodging houses, tenement houses and dormitories. ARTICLE 2 - DEFINITION OF TERMS. - For purposes of this Ordinance, the following terms, words or phrases used shall mean: Boarding House - a building where a person or persons a being charged for sleeping accommodations and meals in a fixed period of time. Lodging House - a building where a person or persons are being charged for sleeping accommodations only. Tenement - a building or portion, thereof, being leased or sold to and occupied as residence by four (4) or more persons doing their cooking within the premises but living independently from one another although having a common right in the use of halls, stairways, terraces, verandas, toilets and baths. Dormitory - a building where students are supplied with and charged for sleeping accommodations and meals whereby males are living in a separate quarters or building from females. Operator - any person, persons, partnership, corporation and/or other similar entities, engage in the business and operation of boarding houses, lodging houses, tenements, and/or dormitories. Tenant - any person living in a boarding house, lodging house, tenement, and/or dormitory within any period of time for a fee. Facilities - refers to sleeping quarters, bathrooms, comfort rooms, and mess halls and other basic amenities. ARTICLE 3 - REQUISITES: SECTION 1. - No operator shall be allowed to establish and, thereafter, maintain a boarding house, lodging house, tenement house, and/or dormitory without first having complied with the following requirements: In addition to the requisites set forth under P.D. 1096, the National Building Code, all operator shall specifically provide at least one (1) comfort room and one (1) bath room, with adequate water supply for every ten (10) prospective tenants, a fire extinguisher, and an emergency exit in case of fire. Payment of current real property taxes with the City Treasurer. SECTION 1. - Established boarding houses, lodging houses, tenements and/or dormitories prior to the enactment of this Ordinance shall, in 90 days after approval of this Ordinance, comply with all the requirement set forth in Article 3 hereof. ARTICLE 5. - PENALTY - Any operator found guilty of violating this Ordinance or any provision hereof shall suffer an imprisonment of not less than fifteen (15) days but not more than thirty (30) days or a fine of not less than Two Hundred (P200.00) Pesos but not more than Six Hundred (P600.00) Pesos or both such fine and imprisonment upon the discretion of the Court. ARTICLE 6. - EFFECTIVITY - This Ordinance shall take effect thirty (30) days after its publication in any of the local newspaper. ENACTED AND APPROVED by the Sangguniang Panlungsod of Pagadian City during its 29th Regular Session, at the Session Hall, on July 24, 1989.
