CITY ORDINANCE NO. 58
"AN ORDINANCE REGULATING VIDEO GAMES OPERATION IN THE CITY OF PAGADIAN AND IMPOSING PENALTIES FOR VIOLATION THEREOF"
BE IT ENACTED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN IN SESSION ASSEMBLED THAT:
ARTICLE I - PURPOSE
This Ordinance aims to prevent minors from absenteeism, skipping classes and tardiness, and encourages all minors to return home early.
ARTICLE II - DEFINITION
a. Minor - any person below eighteen (18) years old.
b. Video Game - any game played through the use of a television screen with computer monitor or similar contraptions or gadgets.
c. Video Game Operator - any person who operates, runs and manages video game facilities for profit.
d. For Profit - operated for a fee or for rent either in cash or in kind.
ARTICLE III - REGULATIONS
SECTION 1. - No video game operator shall allow minors to play video games from 6:00 o' clock in the morning to 5:00 o' clock in the afternoon during regular school days. Any video game operator found to have violated this provision shall be penalized by an imprisonment of not more than one (1) month or a fine of not more than Two Hundred (P200.00) Pesos or both fine and imprisonment at the discretion of the Court and the video game machine shall be forfeited in favor of the City Government.
SECTION 2. - Minor shall be allowed to play video games operated for profit only between 6:00 o' clock in the morning to 5:00 o' clock in the afternoon of any day which is not a regular high school or elementary class day. Any minor found playing outside the allowed days and periods as herein provided shall be imprisoned for five (5) days or be fined the amount of Fifty (P50.00) Pesos or both at the discretion of the Court.
SECTION 3. - Video games operator shall not allow minors to loiter and watch video games from 6:00 o' clock in the morning to 5:00 o' clock in the afternoon during regular school days.
Any video game operator who allow minors to watch video games or loiter nearby while video games are operated outside the period and days allowed for minors shall be imprisoned not more than fifteen (15) days or fined not more than One Hundred (P100.00) Pesos or both at the discretion of the Court and the video game machine shall be forfeited in favor of the City Government.
ARTICLE IV - SEPARABILITY CLAUSE
Should any provision of part of this Ordinance be declared invalid or unconstitutional, the same shall not affect the validity of the provisions or parts of this Ordinance.
ARTICLE V - EFFECTIVITY
This Ordinance shall take effect thirty (30) days after publication.
ENACTED AND APPROVED by the Sangguniang Panlungsod of Pagadian City during its 48th Regular Session held on December 19, 1988.
