CITY ORDINANCE NO. 57


"AN ORDINANCE PROHIBITING VEHICLES TO ENTER PLAZA LUZ AND PROHIBITING DAMAGE TO PLANTS, TREES, INSIDE THE PLAZA LUZ"


BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN CITY THAT:


	SECTION 1. - Purpose - This Ordinance is enacted to protect the trees, grass, flowers, and beauty of Plaza Luz as well as to protect the promenaders.




      SECTION 2. - Definitions:
     1. Vehicle - any bicycle, tricycle, monoped, biped, car, pick-up, bus, truck or any motorized means of land transport.
     2. Plaza Luz - a park in Pagadian City bounded in the East by F.S. Pajares Avenue, North by Arellano Street, South by V. Sagun Street and West by Aquino Street.


      SECTION 3. Maintenance and Protection of Plaza Luz:
     1. No vehicle, bicycle, tricycle, monoped, biped, car, pick-up, bus, truck, is allowed to enter Plaza Luz at any time.
     2. No person may mutilate, cut, kill, transfer, or transplant any tree, bush, grass, plant or flowers within the premises of Plaza Luz or its protective walls and fences without authority from the City Engineer's Office.


      SECTION 4. - Penalties:
     1. Violation of any of the provisions of this Ordinance shall make the violator pay the penalty of a fine of One Hundred (P100.00) Pesos or imprisonment of at least five (5) days and shall make the violator liable for the restoration of the damaged wall, fence, tree, plant, flower, grass, bush and, if not possible, to pay the City the value of the damage suffered.
     2. Violation of Article 2 and 3 shall make the violator liable for the restoration of the damaged wall, fence, plant, grass, flower, bush, tree and, if not possible, to pay the City the value of the damage suffered plus a fine of not less than Fifty (P50.00) Pesos.


      SECTION 5. - Severability - If any Section, Subsection, Sentence, Clause or Phrase of this Ordinance is, for any reason, held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance.


      SECTION 6. - Repeals - All previous ordinances or parts of ordinance inconsistent with the provision hereof are hereby repealed and amended.


	SECTION 7. - Effectivity - This Ordinance shall take effect immediately upon its approval.


      ENACTED AND APPROVED by the Sangguniang Panlungsod of Pagadian City during its 12th Regular Session held on March 28, 1988.
