CITY ORDINANCE NO. 56


"AN ORDINANCE AMENDING ARTICLE III, SECTION 4, PARAGRAPH A, AND ARTICLE IV, SECTION 1 OF CITY ORDINANCE NO. 37, S. 1982"


BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN CITY THAT:


	SECTION 1. - Article III, Section 4, of City Ordinance No. 37, s. 1982 is hereby amended to read as follows:





		"SECTION 4. - MECHANICS OR OPERATION:





              SANITARY GARBAGE RECEPTACLES:


6 Each homeowner, manager, or person in-charge of a business establishment, firm, corporation or association must provide at least one (1) sanitary garbage receptacle for each home, association, business establishment, firm or corporation within the area of operation by the garbage team as delineated by the City Engineer.

              1. The garbage receptacle must not weigh more than 70 kilogram when full and must not exceed one (1) meter in length, one (1) meter in width and one (1) meter in height and to be made of any durable material.
              2. The garbage receptacle must be kept within the premises of the home, business establishment, firm or corporation until the garbage collector is about to collect the garbage. The homeowner, manager, or person in-charge of an association, business establishment, firm, or corporation may then place his/her garbage receptacle in the sidewalk of the street where the garbage collector shall pass. Thereafter, the homeowner, manager or person in-charge of an association, business establishment, firm or corporation has the responsibility of retrieving immediately the garbage receptacle after the garbage has been collected or the garbage truck has passed.
              3. No garbage will be collected if not placed in a proper receptacle. It is the responsibility of the homeowner, manager or person in-charge of an association, business establishment, firm or corporation to keep garbage receptacles in sanitary condition.
              4. The Barangay Captain will have the sole authority to decide whether the garbage receptacle is usable and/or in sanitary condition.



      SECTION 2. Sections 1, 2 and 3, Article IV of City Ordinance No. 37, s. 1982 is hereby amended to read as follows:
      	"SECTION 1. - Violation and Penalties:


           A. Any homeowner, manager, or person in-charge of an association, business establishment, firm or corporation, who fails to provide garbage receptacle a homeowner, association, business establishment, firm or corporation shall suffer the penalty of a fine of not less than One Hundred (P100.00) Pesos or imprisonment of five (5) days. Provided further that any subsequent violation shall be penalized not less than Two Hundred (P200.00) Pesos and not more than Five Hundred (P500.00) Pesos or an imprisonment of not less than ten (10) days and not more than thirty (30)days.
           B. Any person who willfully, knowingly and feloniously spills either partially or fully the contents of a garbage receptacle to a place other than a disposal area or the garbage transport shall suffer the penalty of a fine of not less than One Hundred (P100.00) Pesos or an imprisonment of five (5) days. The same penalty shall also be imposed upon any person who willfully, knowingly and feloniously destroys and damages any garbage receptacle.
           C. Any person who negligently spills the contents of a garbage receptacle shall suffer a fine of not less than Five Hundred (P500.00) Pesos. The same penalty shall also be imposed on negligent damage or destruction to a garbage receptacle.


           SECTION 2. - Severability Clause:


           	Any Section, Subsection, Sentence, Clause or Phrase of this Ordinance if for any reason is found to be unconstitutional, illegal, or invalid, such section, subsection, sentence, clause or phrase shall not affect the validity of the remaining portions of this Ordinance.


           SECTION 3. - Repeals:


           	All previous ordinances or parts of ordinance inconsistent with the provisions hereof are hereby repealed or modified."

	SECTION 3. This Ordinance shall take effect immediately upon its approval.


      ENACTED AND APPROVED by the Sangguniang Panlungsod of Pagadian City during its 12th Regular Session held on March 28, 1988.
