CITY ORDINANCE NO. 55


"AN ORDINANCE PROHIBITING THE LITTERING IN PUBLIC PLACES IN THE CITY OF PAGADIAN AND IMPOSING PENALTIES FOR VIOLATION THEREOF"


BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN CITY THAT:


	SECTION 1. Definition of Terms - The following terms are hereby defined for purposes of this Ordinance, to wit:

          a. To Litter or Littering means to defecate, to throw or discard rubbish, waste materials or garbage, to urinate, and to spit in public places not in receptacles or places intended for the purpose.
          b. Rubbish, Waste Materials or Garbage means all used-up materials of no or inconsequential economic or commercial value, such as fruit peeling, wrappers, discarded shoes and slippers, cigarette butts, empty tin cans, empty bottles and such other similar waste.
          c. Public Places means plaza, streets, alleys, roads, school premises and grounds, canals and ditches, markets, buildings and their premises and grounds and parking areas all owned by the government.



      SECTION 2. It shall be unlawful for any person to commit any of the following acts:
     a. Littering in any of the public places in Pagadian City as defined in Section 1.
     b. Throw human waste and dead animals into garbage cans or receptacles and to any public place as defined in Section 1 hereof.


      SECTION 3. Any person found guilty of littering shall be penalized by a fine of Fifty (P50.00) Pesos or an imprisonment of ten (10) days; for the second offense, the penalty shall be an imprisonment for a minimum of twenty (20) days to a maximum of thirty (30) days or a fine of One Thousand (P1,000.00) Pesos. However, any person arrested for violation of this Ordinance may elect to pay a littering fee of Twenty (P20.00) Pesos as an implied admission of guilt duly receipted by the City Treasurer or his authorized representative in which case the violator shall not anymore be charged in Court.

      SECTION 4. Any ordinance or parts of ordinance inconsistent with the terms and provisions of this Ordinance is or are hereby amended or repealed.


	SECTION 5. This Ordinance shall be known as the ANTI-LITTERING ORDINANCE OF 1988 of the City of Pagadian.

	SECTION 6. This Ordinance shall take effect immediately upon its approval.


      ENACTED AND APPROVED by the Sangguniang Panlungsod of Pagadian City during its 10th Regular Session held on March 14, 1988.
