CITY ORDINANCE NO. 54


"AN ORDINANCE REGULATING, RESTRICTING AND/OR LIMITING THE USE, ENTRY AND/OR PASSAGE ALONG VARIOUS STREETS OF THE CITY"


BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN CITY THAT:


	SECTION 1. Definition of Terms - The terms violator, owner, operator as used in this Ordinance are hereby referred to as:


      1. Violator	-	the person in possession of an unregistered bicycles during the time of apprehension.

      2. Owner	-	the person in whose name a bicycle apprehended for a violation is registered.
      3. Operator	-	the person in whose name bicycles-for-hire are registered.



      SECTION 2. Registration - All bicycles operated within the City of Pagadian are required to be registered with the Office of the City Treasurer.
           A. The bicycle owner/operator shall, before registration, be required to present a certificate of ownership which shall be duly attested by the Station Commander, Integrated National Police.
           B. A registration fee of P15.00 per unit per annum shall be collected by the City Treasurer.
           C. For purposes of physical identification, the City Treasurer shall provide license plate numbers for all registered bicycle unit bearing therein marks to specify if such unit or units registered is/are for private use or for hire, and, in this case, shall be sold to the owner/operator at cost.


      SECTION 3. All persons riding on bicycles shall only be allowed to cross but not to travel along the specified portions of the following streets of the City from 6:00 o' clock in the morning to 8:00 o' clock in the evening, to wit:
     1. J.P. Rizal Avenue (Junction J.S. Alano Street - Araullo Street)
     2. J.S. Alano Street (Junction of F.S. Jamisola - Rizal Avenue)
     3. A. Bonifacio Street (Junction R. Magsaysay Avenue - Cabrera Street)
     4. F.S Pajares Avenue (From PPA Zone, Wharf Area - V. Sagun Street)
     5. B.S. Aquino Street (Junction R. Magsaysay Avenue - V. Sagun Street)

      SECTION 4. All bicycles when used at night time must be properly equipped with head and tail lights.


      SECTION 5. Bicycles-for-hire shall be limited to operate and run only in the premises of Plaza Luz subject to Section 4 of this Ordinance. These bicycles-for-hire shall be under the direct responsibility of the operator/s.


      SECTION 6. Fine and Penalties - Violation of this Ordinance or any part hereof shall be subject to the following measures, to wit:
     A. Violation to Section 1 of this Ordinance would require the violator to register the bicycle/s in question and pay a fine of Fifty (P50.00) Pesos per bicycle.
     B. A fine of Ten (P10.00) Pesos per violation shall be imposed on the owner/operator of any bicycle in question for violation against any of Sections 2, 3 and 4 of this Ordinance.
     C. As provided in this Ordinance, the violator/owner/operator shall be required to pay the accumulated sum of all the violations committed.
     D. Failure of the violator/owner/operator to pay the fine and/or penalty for his/her violation as specified in the preceding subsection would mean the impoundment of the bicycle/s until such time the Certificate of Registration and/or the proper official receipt representing settlement of the fines and penalties for the violation shall be presented.


	SECTION 7. Previous Ordinance or parts thereof which are inconsistent with this Ordinance are hereby amended or repealed.

	SECTION 8. This Ordinance shall take effect immediately upon its approval.


      ENACTED AND APPROVED by the Sangguniang Panlungsod of Pagadian City during its 3RD Regular Session on January 25, 1988.
