CITY ORDINANCE NO. 43


"AN ORDINANCE ESTABLISHING A CURFEW FOR MINORS WITHIN THE CITY OF PAGADIAN, AND PROVIDING PENALTIES FOR VIOLATION THEREOF"

BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN CITY THAT:

      SECTION 1. DEFINITION OF TERMS; WORDS OR PHRASES: As used in this Ordinance the following terms, words or phrases shall have the meaning as indicated below:
     1. MINOR - A minor is any person eighteen (18) years old and below.
     2. CURFEW - means the time when no person is allowed to be roaming abroad.
     3. ROAMING ABROAD - the phrase "Roaming Abroad" mean being outside one's home and/or outside the premises of business during the period of the curfew.


      SECTION 2. THE CURFEW FOR MINORS: Minors are prohibited roaming abroad during the curfew, which for them shall be between the hours of 10:00 o' clock in the evening to 4:00 o' clock in the morning.


      SECTION 3. EXCEPTIONS: The following minors shall be exempted from the curfew:
     1. Those who have curfew passes which will be issued in the following manner:
           a. Those issued by the City Mayor upon recommendation of the Station Commander which are valid within Pagadian City.
           b. Those issued by the Barangay Captains which are valid only within their barangays.
     2. Those who, because of an emergency, are compelled to go abroad for a specific noble purpose.


      SECTION 4. AUTHORITIES TO IMPLEMENT:
      1. Implementation of this Curfew Ordinance may be performed by Barangay Captains but their authority to implement the same is limited only within their territorial jurisdiction and by the PC/INP exclusively.
      2. Arrested violator shall be brought to the Police Station immediately for booking.


      SECTION 5. PENALTIES:
      Upon conviction by the Court the following penalties shall be imposed; however, if the violators are willing to pay the fines/voluntarily as provided for the City Treasurer who will properly issue the receipt, they will be released without the case being filed against them.


     1. For the first offense, violators will be made to work for three (3) hours in the Sariling Sikap Garden of the City and/or to pay a fine of Five (P5.00) Pesos.
     2. For the second and succeeding offenses, the violators will be made to work for six (6) hours in the Sariling Sikap Garden of the City and/or to pay a fine of Ten (P10.00) Pesos.


      SECTION 6. The amount raised from the fines will become a part of the peace and order fund.


      SECTION 7. - Effectivity: This Ordinance shall take effect immediately upon approval by the Mayor.


      ENACTED AND APPROVED by the Sangguniang Panlungsod during its 38th Regular Session held on October 1, 1984.
