CITY ORDINANCE NO. 40
"AN ORDINANCE AMENDING ALL OTHER ORDINANCES AFFECTING THE SALE OF INTOXICATING DRINKS AND/OR INTOXICATING BEVERAGES IN THE CITY OF PAGADIAN"
BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN THAT:
SECTION 1. DEFINITION OF TERMS: As used in this Ordinance the following words or phrases, shall have the following meaning:
a. "Intoxicating drinks" and/or "intoxicating beverages" includes: tuba, beer, basi, gin, rum, whiskey, brandy, cognac, champagne, vodka as well as other kinds of brew with intoxicating effect. Included in the definition of intoxicating drinks and/or intoxicating beverages are the mixtures of any of the aforementioned intoxicants with non-intoxicating drinks and/or intoxicating beverages;
b. "Operator" means the owner and/or manager of a store, carenderia, establishment, restaurant or hotel, where intoxicating drinks or intoxicating beverages are served to customers; Included in the definition of operator as used herein, are the operators of bars or cocktail lounges; night clubs and/or day clubs; dance halls and cabarets; dancing schools, as they are defined under Section 1 of Ordinance No. 14 series of 1978.
c. "Customers" are the persons who drink or imbibe the intoxicating drinks or intoxicating beverages inside the operator's premises;
d. "Minor" means customers below the age of twenty-one(21);
SECTION 2. It shall be unlawful and strictly prohibited for any operator to serve any intoxicating drink or intoxicating beverage to a customer who is a minor;
SECTION 3. PENAL PROVISIONS - Any violation of the provisions of this Article shall be punished by a fine of not less than Two Hundred (P200.00) Pesos nor more than Five Hundred (P500.00) Pesos or suffer an imprisonment of not less than one (1) month nor more than six (6) months, or both fine and imprisonment at the discretion of the Court.
SECTION 4. This Ordinance shall take effect immediately upon its approval.
ENACTED AND APPROVED by the Sangguniang Panlungsod during its 40th Regular Session on October 3, 1983.
