CITY ORDINANCE NO. 36
"AN ORDINANCE CREATING THE SANGGUNIANG PANLUNGSOD SA PAGPAUNLAD"
BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN THAT:
SECTION 1. - CREATION AND NAME -
Consistent with Joint Memorandum Circular CD-82-001 of the Ministry of Human Settlements and Ministry of Local Government, issued in line with the provisions of Executive Order 777 transferring the Community Development functions of the former Ministry of Local Government and Community Development (MLGCD) to the Ministry of Human Settlements (MHS), and of Executive Order 715 establishing the Kilusang Kabuhayan at Kaunlaran (KKK), the Sangguniang Panlungsod sa Pagpaunlad is hereby created. It shall be composed of:
Chairman : City Mayor
Members : Vice Mayor
All Members of the Sangguniang Panlungsod
The ABC President, representing all Barangay Captains
The KB President, representing all KB Chairmen
All Senior Officials of National Agencies/Corporations assigned in the City:
1. MSSD 9. Post Office
2. NACIDA 10. Telecom
3. NFA 11. NEA, rep. by ZAMSURECO
4. MEC 12. LUWA, rep. by PAWAD
5. BFAR 13. BLT
6. BFD 14. Ministry of Trade
7. DBP 15. MAR
8. PNB 16. OMA (Off. Media Affairs)
17. and others
City Officials:
1. City Engineer 6. City Assessor

Four (4) members coming from the private sector to designated by the City Mayor:
1. Business Sector 3. Religious Sector
2. Civic Sector 4. Cultural Minorities
All members from the private sector designated by the City Mayor shall serve for a term of two (2) years. In case of DEATH, INCAPACITY, RESIGNATION, or SEPARATION of a private sector member, the City Mayor shall designate his successor, who shall serve only for the unexpired term of such member who DIED, has become INCAPACITATED, has RESIGNED, and/or has been SEPARATED.
Each private sector member of the Sangguniang Panlungsod sa Pagpaunlad shall be entitled to a per diem of Fifty (P50.00) Pesos, for every UGNAYAN, be it regular or special, attended by them; ALL the rest of the members of the Sangguniang Panlungsod sa Pagpaunlad shall be entitled to a per diem of only Twenty (P20.00) Pesos, for every UGNAYAN, be it regular or special, attended by them.
SECTION 2. "UGNAYAN" (SESSION)
The session of the Sangguniang Panlungsod sa Pagpaunlad shall be officially called "UGNAYAN" to underline the collaborative and coordinative mission of the various Sangguniang Pambarangay sa Pagpaunlad in bringing about community development in their respective areas of responsibilities. Thus, "UGNAYAN" session shall serve as the forum for enlisting opinions, recommendations, and commitments from both the community leaders and the government officials concerned and shall also serve as a mechanism for effecting resources mobilization through a collective and democratic process of community planning and development.
A. UGNAYAN PANLUNGSOD
1. The regular UGNAYAN of the Sangguniang Panlungsod sa Pagpaunlad shall be held on the 2nd Saturday of every month. The time and place shall be at the discretion of the Chairman.
2. Special UGNAYAN may be held upon the call of the Chairman, or the request of one-third (1/3) of the total membership, or the request of three (3) of the members of the Executive Committee.
3. One-third (1/3) of the total membership of the Sangguniang Panlungsod sa Pagpaunlad shall constitute its quorum.
SECTION 3. - POWERS, DUTIES, AND RESPONSIBILITIES OF THE SPP
a. It shall prepare, recommend and keep an up-to-date integrated, realistic, responsive and comprehensive development program designed to achieve effective employment of physical, human and other resources of the City;
b. It shall study and prepare the physical plans for the City of Pagadian, and the development plans for the different barangays and districts under the jurisdiction of the City of Pagadian. It shall also study and recommend to the Sangguniang Panlungsod, economic and social development programs;
c. It shall provide information and technical advice necessary in the adoption of plan and policies and the support needed in the effective implementation thereof;
d. It shall prepare and recommend the criteria or standards in determining priorities for effective implementation of development programs and projects;
e. It shall promulgate rules and regulations for the proper implementation on such development plans, subject to approval of the Sangguniang Panlungsod and the City Mayor;
f. It shall have the power to call public hearings. However, upon failure of the general public to attend two (2) public hearings called by the Board, after wide dissemination by the media, the Sangguniang Panlungsod sa Pagpaunlad shall proceed with its deliberations of matters intended to be taken up in the hearing and recommendations and/or plans adopted by the Board shall be considered final for the proper guidance of the Sangguniang Panlungsod;
g. It shall study and advice the Sangguniang Panlungsod on any subdivision plan submitted to it. Failure of the Sangguniang Panlungsod sa Pagpaunlad to act on any subdivision plan submitted to it for its action, within sixty (60) days after its submission, the Sangguniang Panlungsod then may act on the matter without waiting for the action of the Sangguniang Panlungsod sa Pagpaunlad;
h. It shall study, prepare, and recommend to the Sangguniang Panlungsod Zoning Regulations, Sanitation and Beautification Regulations, as the Sangguniang Panlungsod sa Pagpaunlad may deem appropriate and beneficial to public interest;
i. It shall have the power to recommend amendments to existing development plans as it may deem proper and beneficial to public interest;
j. It shall have the power to adopt rules of procedures to govern its internal administration;
k. It shall coordinate at the City level the extension programs, priorities and field operations of the various ministries and agencies of the National Government as well as government corporations, through their senior personnel assigned in the area;
l. It shall promote the Kilusang Kabuhayan at Kaunlaran;
m. It shall monitor and coordinate at City Level livelihood projects, including those under the Kilusang Kabuhayan at Kaunlaran;
n. It shall utilize the City Planning and Development Staff and Technical Committees and other organized task forces which shall:
1. Conduct Community Surveys
2. Undertake Feasibility Studies
3. Organize Local Community Organization, strengthen existing ones and involve them in program implementation.
4. Undertake trainings for leaders of community organizations directed powers program operations, develop interests in self-help and stir group action.
5. Undertake action research in pilot areas.
SECTION 4. - EXECUTIVE COMMITTEE. -
An Executive Committee to be composed of the City Mayor or his authorized representative as Chairman, with the City Development Officer, and the Human Settlements Officers (HSO) or in his absence the Municipal Settlement Assistant (MSA), the City Administrator/Planning Director, and the City Engineer as members, shall be operationalized to exercise the powers and functions of the Sangguniang Panlungsod sa Pagpaunlad when it is not in session, provided, that all actions or resolutions taken by the Executive Committee shall be submitted to the ensuing Board Session for ratification.
SECTION 5. - SUPPORT STAFFS. -
a. City Secretariat - The Human Settlements Officer (HSO) assisted by the Municipal Settlements Assistant (MSA) in coordination with the Office of the Mayor shall provide the Secretariat support of the Sangguniang Panlungsod sa Pagpaunlad.
The City Secretariat shall have the following functions:
1. To coordinate with the various government and private agencies represented in the UGNAYAN with regard to the their participation and project commitments.
2. To extend technical support particularly on livelihood and shelter projects.
3. To prepare all documents and information for the dissemination to all UGNAYAN participants at the City Level.
b. Technical Staff - Unless otherwise reorganized, the existing Planning and Development Staff of the City of Pagadian, which is presently composed of the following personnel: The City Administrator or Planning Director, as its head; an Urban Planner, a Management Specialist, an Economist, a Sociologist, an Engineering Analyst, a Fiscal Analyst, an Statistician, shall be maintained and shall serve as the technical staff of the Sangguniang Panlungsod sa Pagpaunlad.
In addition to the functions outlined and enumerated under Section 3, subsection n, of this Ordinance, the Technical Staff shall also perform the following functions:
1. To assess the needs and potentials of the City for development through the conduct of surveys of physical characteristics, socio-economic conditions and resources, and to compile, synthesize, and analyze the date or results obtained therefrom for the purpose of preparing a comprehensive development plan;
2. To provide technical assistance and services relative to development planning;
SECTION 6. FUNDING -
The Sangguniang Panlungsod shall appropriate funds for the maintenance and operational requirement of the Sangguniang Panlungsod sa Pagpaunlad.
SECTION 7. REPEALING CLAUSE - Any ordinance(s) and/or existing regulations in the City of Pagadian in consistent with the provisions of this Ordinance are hereby amended, repealed or modified accordingly.
SECTION 8. EFFECTIVITY CLAUSE - This Ordinance shall take effect immediately upon its approval.
ENACTED AND APPROVED by the Sangguniang Panlungsod of Pagadian, during its 34th Regular Session on December 13, 1982, at the Sangguniang Panlungsod of Pagadian City.
