ORDINANCE NO. 6
"AN ORDINANCE PROVIDING THE RULES AND REGULATIONS GOVERNING CONSTRUCTION, REMODEL AND REPAIR OF HOUSES, BUILDING, AND OTHER SIMILAR STRUCTURES WITHIN THE CITY OF PAGADIAN AND IMPOSING PENALTIES FOR VIOLATION THEREOF"
BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN THAT:
SECTION 1. It shall be unlawful for any person or persons, entity or corporation to construct, build, remodel and repair a house or building within the City of Pagadian without first securing for the purpose a permit from the Office of the Mayor and without paying the corresponding fees in the Office of the City Treasurer.
SECTION 2. As used in this Ordinance, building shall be either a public or private building, structure, or edifice by the government, government controlled corporation, or a private building, structure, edifice.
SECTION 3. All applications for building permit shall be filed with the Office of the City Engineer and must be accompanied by a sketch or building plan showing all the information required under Section 7 hereof.
Sketch or building plans for building for public use and buildings costing P10,000.00 or more shall be prepared and signed by a duly licensed civil engineer or architect showing thereon the number, date and place of issue of his privilege tax receipt.
Sketch or building plans for building costing less than P10,000.00 may be prepared by a competent carpenter or contractor with experience in building construction work duly approved by the City Engineer or his duly authorized representative.
Building of nipa, bamboo and woods of any light materials do not necessarily need a detailed sketch as required for buildings of strong materials.
Proposed appendages or extension to any extension house and buildings shall likewise be covered by a corresponding sketch or building plans as herein above-enumerated.
SECTION 4. The distance from (a) the center of the municipal street or road to the building line shall be not less than Ten (10) Meters, the center of Provincials road, not less than Fifteen (15) Meters, and the center of national road, not less than Thirty (30) Meters; (b) the building line to any existing building line shall not be less than Two (2) Meters, unless a fire wall is provided, and (c) the building line to the limits to the lots within which the building is constructed shall be not less than One and a Half (1 �) Meters, unless a fire wall is likewise provided.
SECTION 5. In the port area along side the causeway the house or building shall follow an alignment of not less than Thirty (30) Meters from the center of the causeway, and foot bridges are allowed to be constructed between the house and the causeway, provided the said bridges shall be as wide as the house itself and of the same level as concrete curb thereon and that no posts shall be erected on or too close to the rock riprapping of the causeway.
SECTION 6. The sketch or building plans accompanying application for building permit made in writing and bearing the favorable recommendation of the City Engineer or his duly authorized representative, the City Health Officer, the Station Commander of the Integrated National Police, the City Administrator or the City Planning and Development Staff shall show the following data:
1. Dimension of the structure
2. Kind of material to be used
3. Estimated cost of the construction
4. Kind of toiled
5. Distance from the center of the road or street
6. Distance from any other building and adjacent lots
7. Tax Declaration Number
8. Number of official receipt evidencing payment of the land tax for the current year
SECTION 7. Any person or persons, entity or corporation violating any provisions of this Ordinance shall, upon conviction of the Court, be penalized by a fine of not less than Five Hundred (P500.00) Pesos nor more than One Thousand (P1,000.00) Pesos with subsidiary imprisonment or to suffer an imprisonment of not less than one (1) month nor more than six (6) months, or both such fine and imprisonment at the discretion of the Court.
SECTION 8. All ordinances, rules and regulations or part thereof inconsistent with the provision of this Ordinance are hereby repealed or modified accordingly.
SECTION 9. This Ordinance shall take effect immediately upon its approval.
ENACTED AND APPROVED by the Sangguniang Panlungsod, this City, during its 2nd Regular Session on February 7, 1977, at the Session Hall.
