ORDINANCE NO. 10
"AN ORDINANCE AMENDING SECTIONS 1,2 & 3 OF ORDINANCE NO. 4, S. 1973, ENTITLED: "AN ORDINANCE PROHIBITING ANY PERSON(S) FROM INTRODUCING AND/OR CONSTRUCTING IMPROVEMENTS OR BUILDINGS AT THE BURNED AREA OF STA. LUCIA DISTRICT AND IMPOSING PENALTIES FOR VIOLATION THEREOF"
BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN THAT:
SECTION 1. Section 1 of Ordinance No. 4, s. 1973 is hereby amended to read as follows:
"SECTION (1) - Any person, persons or entity are hereby prohibited from introducing any improvements or from constructing any building made of either permanent or light materials within the burned area of Sta. Lucia District as defined below:
The burned area herein referred to is bounded on the North by Ramon Magsaysay Avenue; on the South by Tulingan Road (now Marcelo Dablo St.); on the East by Mabini St.; and on the West by Araullo Street.
Provided that the City Government may build, construct and improve a building within the area above-described, either permanent or temporary structures as the City Mayor may determine."
SECTION 2. Section 2 of Ordinance No. 4, s. 1973 is hereby amended to read as follows:
"SECTION 2 - Any person, persons or entity found violating this Ordinance shall, upon conviction by the Court, pay a fine of not less than One Hundred Pesos (P100.00) but not more than Two Hundred Pesos (P200.00) and shall suffer an imprisonment of not less than thirty (30) days but not more than ninety (90) days and shall further remove, demolish all the improvements and/or construction within ten (10) days upon finality of the decision otherwise the City Engineer shall remove/demolish the construction and improvement at the expense of the convicted person."
SECTION 3. Section 3 of Ordinance No. 4, s. 1973 is hereby amended to read as follows:
"SECTION 3 - All ordinances, rules and regulations which are inconsistent with this Ordinance are hereby repealed or modified accordingly."
SECTION 4. This Ordinance shall take effect immediately upon its approval.
ENACTED AND APPROVED by the Sangguniang Panlungsod, this City, on September 5, 1977, during its 9th Regular Session.
