ORDINANCE NO. 2
"AN ORDINANCE PRESCRIBING RULES AND REGULATION FOR THE PROPER PRESERVATION AND MAINTENANCE OF ANY GOVERNMENT AND/OR PRIVATE IRRIGATION LATERALS, CANALS, AND FARM DITCHES, AND IMPOSING PENALTIES FOR ANY VIOLATION THEREOF"
BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD OF PAGADIAN THAT:
SECTION 1. No person or persons shall be allowed to let his/their work animals, such as carabaos, cows, horses, etc., to wallow into the bed of any government and/or private irrigation, laterals, canals, and ditches.
SECTION 2. It shall be unlawful for any person or persons and/or owner/s of the above-mentioned animals to let his/their work animals cross the above-named irrigation laterals, canals and farm ditches without first constructing protective gadget/s concrete culverts or strong bridge over them other than those which were already provided thereon, if there is any, with the approval of the authorities concerned or that a person owning or maintaining the private irrigation system.
SECTION 3. It shall likewise be unlawful for any person or persons to injure or destroy any irrigation dam, headgate, wire, beachwork, monument and other appliances for the carriage, diversion, storage, apportioning or measurement of water, or any hydrographic or tonographic survey.
SECTION 4. It shall also be unlawful for any other person or persons to interfere, obstruct, or divert the course of the water pertaining to government and/or private irrigation system existing within the jurisdictional limits of Pagadian City without prior permission or approval of the government authorities and/or that of the private person/s owning or maintaining the above-mentioned irrigation laterals, canals, and farm ditches.
SECTION 5. PENALTY - Any violation of this Ordinance shall be punished by a fine of not less than Fifty (P50.00) Pesos and not more than Two Hundred (P200.00) Pesos and to pay the cost of any damage done, with the subsidiary imprisonment in case of insolvency.
SECTION 6. This Ordinance shall take effect immediately upon its approval.
ENACTED AND APPROVED by the Sangguniang Panlungsod ng Pagadian during its 4th Special Session on April 19, 1976.
