"AN ORDINANCE DESIGNATING AS A TEMPORARY PARKING AREA THE PREMISES WITHIN THE BURNED OLD PUBLIC MARKET AND REQUIRING ALL PASSENGER TRUCKS, BUSES, JEEPNEYS AND MOTORCABS WITHOUT A LICENSED TERMINAL OF THEIR OWN TO PARK FOR LOADING AND UNLOADING PURPOSES THEREAT IMPOSING FEE THEREFOR AND IMPOSING PENALTIES FOR THE VIOLATION OF ITS PROVISIONS"
BE IT ORDAINED BY THE CITY BOARD OF PAGADIAN, THAT:
SECTION 1. The premises within the burned old public market in the City of Pagadian is hereby designated as a temporary parking area for all passenger buses, trucks and jeepneys without a licensed terminal of their own.
SECTION 2. All passenger buses, trucks and jeepneys without a licensed terminal of their own are required to load and unload their passenger and cargoes within the parking area so designated in Section 1, hereof. No passenger buses, trucks, jeepneys will be allowed to solicit passengers and cargoes nor to load and unload them except within their own terminal area or in the designated City Parking Area.
SECTION 3. All passenger buses, trucks and jeepneys availing of the designated city parking area shall pay parking fees in accordance with the following schedule of rates:
Per Departure
a) Per bus with passenger capacity of 50 or more P3.00
b) Per bus with passenger capacity of not less than 30 but not more than 50 2.00
c) Per mini bus 1.50
d) Per jeep or ford fierra 1.00
e) Per motorcab 0.25
SECTION 4. Any driver and/or in the proper case, the operator of the passenger bus, trucks or jeepney, who violates any of the provisions of this Ordinance, shall upon conviction, suffer the penalty of imprisonment of not less than ten (10) days but not more than twenty (20) days or a fine of not less than Twenty-Five (P25.00) Pesos but not more than Fifty (P50.00) Pesos, or both such fine and imprisonment at the discretion of the Court.
SECTION 5. The erring driver and/or passenger may, in the event of an apprehension for the violation of any of the provisions of this Ordinance, elect to forego court proceedings on the apprehension by paying directly to the City Treasure, an administrative fine of Twenty (P20.00) pesos. The payment of the administrative fine shall be made prior to the filing of the case before the court, and shall have the effect of double jeopardy as far as the said particular relation is concerned.
SECTION 6. Any existing Ordinance or part thereof which is inconsistent with this Ordinance or any part hereof is hereby deemed amended or repealed.
SECTION 7. This Ordinance shall take effect immediately upon its approval and shall continue to be in force until a regular City Parking Area and/or terminal shall have been established unless sooner repealed.
SECTION 8. Any provision of this Ordinance or portions thereof that may be declared unlawful and or unconstitutional shall not affect the validity of the remaining portions not directly affected by such declaration.
