ORDINANCE NO. 5
"AN ORDINANCE PROHIBITING THE LITTERING IN PUBLIC PLACES IN THE CITY OF PAGADIAN AND IMPOSING PENALTIES FOR VIOLATION THEREOF"
BE IT ORDAINED BY THE CITY BOARD OF PAGADIAN, THAT:
SECTION 1. Definition of Terms: The following terms are hereby defined for purposes of this Ordinance, to wit:
a. To litter or littering means to throw or discard rubbish, waste materials or garbage in public places not in receptacles intended for the purpose.
b. Rubbish, waste materials or garbage means all used-up materials of no or inconsequential economic or commercial value such as, waste papers, cigarette butts, match sticks, fruit peeling, wrappers, discarded shoes and slippers, empty tin cans, empty bottles, dead animals, and such other similar wastes.
c. Public places means plazas, streets, alleys, roads, school premises and grounds, public canals and ditches.
SECTION 2. It shall be unlawful for any person to litter in any public places in the City of Pagadian, in the manner defined in Section 1 hereof.
SECTION 3. Any person found guilty of littering shall be penalized by a fine of Five (P5.00) Pesos and in case of insolvency to suffer imprisonment of two (2) days; for the second and other succeeding offenses, the penalty shall be an imprisonment in the discretion of the Court. However, any person arrested for violation of this Ordinance may elect to pay Two (P2.00) Pesos as littering fee duly receipted by the City Treasurer or his duly authorized representative, in which case the violator shall not anymore be charged in Court.
SECTION 4. Any ordinance or parts of this Ordinance inconsistent with the terms and provisions of this Ordinance is or are hereby amended or repealed.
SECTION 5. This ordinance shall be known as "The Anti-Littering Ordinance of 1973 of the City of Pagadian."
SECTION 6. This Ordinance shall take effect immediately upon its approval.
ENACTED AND APPROVED by the City Board of Pagadian, during its 7th Regular Session on February 9, 1973, at the Session Hall, Pagadian City.
