ORDINANCE NO. 16
"AN ORDINANCE AMENDING SECTION 3, AND SECTIONS 19(b), 19(c), 19(e) OF ORDINANCE NO. 8, C.S., OTHERWISE KNOWN AS THE SUBDIVISION REGULATIONS OF PAGADIAN CITY"
BE IT ORDAINED BY THE CITY BOARD OF PAGADIAN, THAT:
SECTION 1. Section 3 of Ordinance No. 8, c.s., otherwise known as the SUBDIVISION REGULATIONS OF PAGADIAN CITY is hereby amended to read as follows:
"SECTION 3. - PERMIT REQUIREMENTS - It shall be unlawful for any person, partnership, company or corporation to subdivide and sell lands or to enter into contract with option to buy or sell within the City of Pagadian unless the preliminary subdivision plan is duly recommended for approval by the City Engineer and approved by the City Board through the City Mayor."
SECTION 2. Section 19(b) of Ordinance No. 8, c.s., or the Subdivision Regulations of Pagadian City is hereby amended to read as follows:
"Section 19(b). SEQUENCE - The preliminary plans shall be presented to the City Engineer for payment of all necessary subdivision fees. After the payment of the said fees, the City Engineer, after studying the plans, shall forward the same together with his comments and recommendations to the City Board through the City Mayor for their approval."
SECTION 3. Section 19(c) of Ordinance No. 8, c.s., or the Subdivision Regulations of Pagadian City is hereby deleted and/or abrogated.
SECTION 4. Section 19(e) of Ordinance No. 8, c.s., or the Subdivision Regulations of Pagadian City, is hereby amended to read as follows:
"Section 19(e). APPROVAL BY THE CITY MAYOR AND CITY BOARD - The City Mayor and the City Board will act on the application as per recommendations of the City Engineer. If approved, the plan shall be stamped "APPROVED."
SECTION 5. All other provisions of Ordinance No. 8, c.s., or the Subdivision Regulations of Pagadian City, in as far as they relate to the Director of Planning or National Planning Commission are hereby repealed or abrogated.
SECTION 6. The term "CITY COUNCIL" as used in Ordinance No. 8, c.s., or the Subdivision Regulations of Pagadian City is hereby amended to read as "CITY BOARD."
SECTION 7. This Ordinance shall take effect immediately upon approval.
ENACTED AND APPROVED by the City Board of Pagadian during its 20th Regular Session on May 7, 1971.
