ORDINANCE NO. 4


"AN ORDINANCE IMPOSING PERCENTAGE TAX ON BEAUTY CONTEST CONDUCTED BY PRIVATE ENTITIES OR PERSONS TO BE CALLED SPECIAL PLAZA FUND AND PROVIDING PENALTIES THEREFOR"


	BE IT ORDAINED BY THE CITY BOARD OF PAGADIAN, THAT:


      SECTION 1. Definition of Beauty Contest - Beauty contest within the context of this Ordinance, shall include but not inclusive, the selection of queen, muse or otherwise, by means of money to represent as votes of the respective beauty contestants.


      SECTION 2.	No beauty contest shall be held or conducted by private persons, schools or entities without securing the necessary permit from the Office of the Mayor. No charge shall be imposed for this permit.


      SECTION 3.	A percentage tax of 10% shall be imposed from the gross proceeds of beauty contest, which shall accrue to the Special Plaza Fund and shall be collected by the City Treasurer within 5 days immediately upon the conclusion of the beauty contest.


      SECTION 4. All monies of the Special Plaza Fund shall be expended exclusively for the beautification and/or maintenance of the Pagadian City Plaza in accordance with the standing procedures as any other fund of the City.


      SECTION 5.  Any person found guilty for violation of this ordinance shall be punished by imprisonment of not less than ten (10) days but not more than thirty (30) days and fine of not less than fifty (P50.00) pesos but not more than two hundred (P200.00) pesos. In case of a corporation, partnership or association, the manager shall be responsible therefore. In addition, permit to hold beauty contests may be denied of the said person.


      SECTION 6. This Ordinance shall take effect upon its approval.


      ENACTED by the City Board of Pagadian on January 21, 1970.
