ORDINANCE NO. 38
"AN ORDINANCE REGULATING THE SHIPMENT OF LARGE CATTLE OUTSIDE THE CITY OF PAGADIAN AND THOSE LARGE CATTLE PASSING IN TRANSITU AND PROVIDING PENALTIES FOR VIOLATION THEREOF"
BE IT ORDAINED BY THE CITY BOARD OF PAGADIAN, THAT:
SECTION 1. TITLE - This Ordinance shall be known as the ANTI-CATTLE RUSTLING ORDINANCE OF THE CITY OF PAGADIAN.
SECTION 2. DEFINITION OF TERM
Large Cattle includes those animals such as cows, carabaos, horses and those belonging to the bovine family, as defined and used in the Revised Penal Code.
SECTION 3. It shall be unlawful for an owner, dealer or shipper, whether engaged in business of large cattle or not, within the City of Pagadian, to transport or ship any kind of large cattle outside the City of Pagadian, without first securing a transportal permit from the City Mayor or his authorized representative, and the payment of verification fees to the City Treasurer, within the period of two (2) days before the date of shipment.
SECTION 4. The owner, dealer or shipper is required to exhibit to the City Mayor and to the City Treasure, or their authorized agents, the corresponding certificates of ownership or transfer, including the certificate of inspection issued by the Provincial Veterinarian, or his agent, together with the P.C. Clearance and Transportal Permit, issued by the P.C. Provincial Commander or his authorized representative, two (2) days before the date of shipment, during official business hours.
SECTION 5. The following are the legal fees to be paid as herein provided:

b. Treasurer's Verification Fee 5.00

c. Treasurer's Verification Fee 5.00
(Cattle passing through Pagadian City)
SECTION 6. No person or persons, owner, dealer, or shipper of any large cattle coming from different places o the Philippines shall be allowed to pass through the territory of Pagadian City, unless such person, owner, dealer or shipper shall exhibit to the City Mayor and to the City Treasurer the pertinent documents of such shipment duly issued by the authorities concerned required under existing law, and only after paying the corresponding verification fees to the City Treasurer, hereto provided, within a period of one (1) day before the date of shipment, during official business hours.
SECTION 7. For the purpose of implementing the spirit of this Ordinance, the City Mayor and the City Treasurer or his duly authorized representatives, this City, together with the P.C. Command, through the Provincial Commander, Pagadian City, upon request by the City Authorities, shall coordinate and act harmoniously, in all matters of inspection, verifications and the issuance of permits, in connection with the shipment of large cattle outside the City of Pagadian.
SECTION 8. The owner, dealer or shipper who shall be convicted by a final judgment for violating this Ordinance shall pay a fine of not less than Twenty-Five (P25.00) Pesos but not more than Fifty (P50.00) Pesos and to suffer an imprisonment of not less than ten (10) days, but not more than fifty (50) days, or both such fine and imprisonment at the discretion of the Court.
SECTION 9. All large cattle originating from the City of Pagadian and those passing through the City shall be impounded not less than three (3) days but not more than five (5) days at a place designated by the City Mayor, the Chief of Police, or the City Warden before the final shipment to other places; and that the City Government shall not be held liable for the feeding and maintenance of such cattle or animals as well as for any loss, injury, damage and death thereof during the period of impounding.
SECTION 10. Any existing law, rule or regulation inconsistent with the provisions of this Ordinance is hereby repealed.
SECTION 11. This Ordinance shall take effect immediately upon its approval.
