ORDINANCE NO. 24


"AN ORDINANCE PROHIBITING PERSON OR PERSONS, PARTNERSHIP OR CORPORATION, STEVEDORES OR ARRASTRE AND PORTERS TO OPERATE AND WORK AT THE WATERFRONT OF THE CITY OF PAGADIAN OR ELSEWHERE WITHOUT PROPER REGISTRATION AND IDENTIFICATION AND IMPOSING PENALTIES FOR VIOLATION THEREOF"

	BE IT ORDAINED BY THE CITY BOARD OF PAGADIAN, THAT:


      SECTION 1. Definition of Terms:
     a. Labor/Porter/Partnership or Corporation, Person or Persons - are union of working men whose organizations are registered under the laws of the Republic of the Philippines.
     b. Stevedores/Arrastre Service - are union of working men engaged in the loading and unloading of cargoes of any kind, usually covered by Bills of Laddings; from the boat to the Wharf, and vice versa, including all deliveries/hauling to the bodegas, and vice versa.
     c. Porters, are group of working men engage primarily in carrying personal effects/belongings of a passenger in transitu, from the bus to the Wharf Area, and vice versa, unless there is a contact between the parties concerned.
     d. Personal Effects/Belongings -  are goods or merchandise of any kind of the passenger carried/transported in transitu usually not covered by bill of laddings.


      SECTION 2. To require such person or persons, partnership or coporation, stevedores, arrastre, and porters to REGISTER themselves as a union, and to file and submit the lists of members, at least once a month, relative to any changes or admission of new members, at the Office of the Chief of Police for the purpose of securing the necessary police clearance, provided, that no registrtion fee shall be imposed for the service of registration.


      SECTION 3. That such union, corporation, stevedores, arrastre and porters union shall prescribe uniforms of their working men which must bear a distinct number printed at the back side, and the name of the union at the frontside for identification; and to require each working man to wear uniform while performing the work at the Wharf area or elsewhere within the city limits.


      SECTION 4. It shall be unlawful for any person, stevedor, arrastre and proter to operate and work at the waterfront of Pagadian City or elsewhere without identifying himself as a member or affiliated to any registered union thereof.


      SECTION 7. Any person convicted for violation of this ordinance shall pay a fine of not less than ten (P10.00) pesos but not more than twenty-five (P25.00) pesos or an imprisonment of not less than four (4) days but not more than ten (10) days and in case of the union, shall pay a fine of not less than fifty (P50.000 Pesos but not more than One Hundred (P100.00) Pesos to be imposed upon its President or its  authorized representative for that purpose at the discretion of the Court.


      SECTION 8. This Ordinance shall take effect immediately upon its approval.


      ENACTED AND APPROVED by the City Board of Pagadian during the Regular Session on July 6, 1970.
