ORDINANCE NO. 13


"AN ORDINANCE PROHIBITING PERSON FROM CARRYING FIREARMS AND/OR DEADLY WEAPONS INSIDE BARS, RESTAURANTS, THEATERS, BILLIARD HALLS, BOWLING ALLEYS, COCKPITS, CHURCHES, PUBLIC DANCING PLACES, NIGHT CLUBS, COCKTAIL LOUNGES, SCHOOLS, GYMNASIUM, GAMBLING HOUSES AND SIMILAR PLACES AND IMPOSING PENALTIES FOR VIOLATION THEREOF "

	BE IT ORDAINED BY THE CITY BOARD OF PAGADIAN, THAT:


      SECTION 1. Persons are prohibited to carry firearms and/or deadly weapons inside bars, restaurants, theaters, billiard halls, bowling alleys, cockpits, churches, public dancing places, night clubs, cocktail lounges, schools, gymnasium, gambling houses and similar places, except peace officers in the actual performance of their duties. Firearms or deadly weapons confiscated by Peace Officers shall be forfeited in favor of the government, without prejudice to the violation of Special Laws.


      SECTION 2. Terms Define:


     a. "Persons" includes civilians, government employees, members of the Philippine Constabulary, Police of other Cities and Municipalities, security guards of duly accredited security agencies and members of the Pagadian City Police Department;
     b. "Deadly Weapons" include any bladed or sharp pointed instrument.


      SECTION 3. Any person or persons convicted for violation of this ordinance shall be punished, for the FIRST OFFENSE by a fine of not less than Twenty-Five (P25.00) Pesos but not more than Fifty (P50.00) Pesos or an imprisonment of not less than ten (10) days but not more than twenty (20) days or both fine and imprisonment; for the SECOND OFFENSE, a fine of not less than Thirty-Five (P35.00) Pesos but not more than Seventy (P70.00) Pesos or an imprisonment of not less than fifteen (15) days but not more than thirty (30) days or both fine and imprisonment and for the succeeding offenses by a fine of not less than Fifty (P50.00) Pesos but not more than One Hundred (P100.00) Pesos or an imprisonment of not less than twenty (20) days but not more than forty (40) days or both fine and imprisonment in the discretion of the Court.


      SECTION 4. This Ordinance repeals Ordinance No. 38, series of 1966.


      SECTION 5. This Ordinance shall take effect immediately upon approval.


      ENACTED by the City Board of Pagadian during its Regular Session on March 18, 1970.


      APPROVED by His Honor, the Mayor, on April 13, 1970.
