ORDINANCE NO. 8
"AN AMENDMENT OF ORDINANCE PROHIBITING MOTOR CAB DRIVERS FROM OVERTAKING OTHER MOTOR CABS AND/OR MOTOR VEHICLES WITHIN THE POBLACION OF PAGADIAN AND IMPOSING PENALTIES FOR VIOLATION THEREOF"
BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN, THAT:
SECTION 1. It shall be unlawful and strictly prohibited for any motor cab driver to overtake other motor cab or motor vehicle while the other motor cab or motor vehicle is running or in motion, within the poblacion of Pagadian, except in emergency cases, enumerated as follows:
a) when the passenger is a patient who needs immediate medical attention;
b) when the motor cab driver of the passenger is going to report to police authorities of any incident requiring police intervention or attention;
c) when the motor cab driver or passenger is going to report of a fire to the Fire Department authorities.
SECTION 2. Any motor cab driver convicted by the Court for violation of Section 1 hereof, shall pay a fine of not less than Ten (P10.00) Pesos nor more than Fifty (P50.00) Pesos and shall suffer an imprisonment of not less than one (1) month nor more than six (6) months, in the discretion of the Court.
SECTION 3. This Ordinance amends Ordinance No. 4, series of 1964, and other ordinances inconsistent with any of the provision of this Ordinance.
SECTION 4. This Ordinance shall take effect immediately upon its approval.
