ORDINANCE NO. 4


"AN ORDINANCE PROHIBITING THE ESTABLISHMENT AND OPERATION OF NIGHTCLUBS, COCKTAIL LOUNGE OR BAR EMPLOYING HOSTESS OR WOMEN AND/OR EFFEMINATES, WITHIN THE POBLACION OF PAGADIAN AND IMPOSING PENALTIES FOR VIOLATION THEREOF"


	BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN, THAT:

	SECTION 1. No nightclubs, cocktail lounge or bar employing hostess or women and/or effeminates shall be established within the poblacion of Pagadian.

		For purposes of this Ordinance, poblacion of Pagadian is comprised within the following boundaries:

		North - San Jose Water Reservoir
		South - 100 meters of shore line and/or the wharf
		East - Bulatok river adjacent to the PC Camp
		West - Balangasan river

	SECTION 2.	 Any form of immoral or indecent acts outside or within the premises of nightclubs, cocktail lounges or bars are strictly prohibited.

	SECTION 3.	 No minor shall be allowed to enter a night club during business hours.

      SECTION 4.	 (a) Any operator, owner or proprietor found guilty for violation of Section 1 hereof, shall be punished by an imprisonment of not less than two (2) months nor more than six (6) months or fine of not less than One Hundred (P100.00) Pesos but not more than Two Hundred (P200.00) Pesos or both such fine and imprisonment in the discretion of the Court.


      (b) Any operator or manager tolerating violation of Sections 2 and 3 hereof shall be punished by imprisonment of not less than one (1) month but not more than three (3) months or fine of not less than Fifty (P50.00) Pesos but not more than One Hundred (P100.00) Pesos or both such fine and imprisonment in the discretion of the Court.


      � Any person found guilty for violation of Section 2 hereof shall be punished by imprisonment of not less than two (2) months but not more than six (6) months or fine of not less than One Hundred (P100.00) Pesos but not more than Two Hundred (P200.00) Pesos or both such fine and imprisonment in the discretion of the Court.


      (d) Any minor found guilty for violation of Section 3 hereof shall be punished by imprisonment of not less than ten (10) days but not more than thirty (30) days or fine of not less than Thirty (P30.00) Pesos but not more than Sixty (P60.00) Pesos or both such fine and imprisonment in the discretion of the Court.


      SECTION 5.	 Any ordinance or part thereof inconsistent to any provision of this Ordinance is hereby deemed repealed, amended or abrogated.
      SECTION 6.	Any violation of this Ordinance shall be sufficient ground for the revocation of permit.


      SECTION 7. This ordinance shall take effect on April 1, 1968.
