ORDINANCE NO. 32
"AN ORDINANCE AMENDING ORDINANCE NO. 17, SERIES OF 1962, PROVIDING FOR THE EXTENSION OF THE PERIOD OF THE LEASE CONTRACT OF THE OCCUPATION OF THE LOTS SURROUNDING THE OLD PUBLIC MARKET TO TERMINATE ON DECEMBER 31, 1970, AND FOR THE ACCEPTANCE OF DONATIONS FOR THE REHABILITATION OF THE OLD PUBLIC MARKET BUILDING"
BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN, THAT:
SECTION 1. The period of the lease contract of the occupants of the lots surrounding the old public market who shall give donations to the Municipality for the rehabilitation of the old public market building according to the following schedule of amounts enumerated below as petitioned by them, shall be extended to December 31, 1970.
a) Two Hundred (P200.00) Pesos for every apartment along the National Highway and Mabini Street.
b) One Hundred (P100.00) Pesos for every apartment along Bonifacio Street and Jamisola Street.
c) Fifty (P50.00) Pesos for every apartment located inside the old public market premises.
SECTION 2. The payment of donation to the authorized person is a conditio sine qua non for the extension of the period of the lease contract up to and not beyond December 31, 1970.
SECTION 3. The privilege granted herein for the extension of the period of the lease contract to December 31, 1970 shall end on June 30, 1963.
SECTION 4. No lease contract of any market lot occupant shall be extended after June 30, 1963, which is the deadline for the payment of donations.
SECTION 5. No Municipal Treasurer of Pagadian is authorized to accept donations for the rehabilitation of the old public market building and to issue official receipts thereof.
SECTION 6. The lease contract shall provide therein the prohibition of sub-leasing or selling the occupation to other persons.
SECTION 7. The lessee who shall have given the Municipality the aforementioned donation shall pay the same rental without increase until December 31, 1970.
SECTION 8. Any violation of the provisions of this Ordinance will cause the forfeiture of lessee's store in favor of the government which shall have the option to award the same to a new lessee through bidding or to the actual occupant.
SECTION 9. Any ordinance or part thereof inconsistent with any of the provision of this Ordinance is hereby repealed or amended.
SECTION 10. This ordinance shall take effect upon approval.
