ORDINANCE NO. 14
"AN ORDINANCE REGULATING HOTELS, MOTELS, AND GUEST HOUSES FIXING GUEST TAX AND PROVIDING PENALTIES FOR VIOLATION THEREOF"
BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF PAGADIAN, THAT:
SECTION 1. Definition of Hotel - A hotel is a building or house where any guest is admitted to lodge upon payment of a certain amount of money on a day-to-day basis or a fraction thereof. The term hotel shall include motels and guest houses.
SECTION 2. Hotel Book - Every hotel shall keep a book paged consecutively registered with the Office of the Municipal Treasurer. Each paged shall contain the following data, to wit: (a) full name of guest; (b) home address; (c) residence certificate number; (d) date and time checked-in; (e) date and time checked-out; (f) room assigned and (g) date of inspection. It shall be the duty of the Municipal Treasurer or his authorized representative to make periodic inspection of the Hotel Book and see to it that the provisions of this Ordinance are strictly complied with by the hotel operator. The same hotel book register as required by the Bureau of Internal Revenue may be used under this Section.
SECTION 3. Guest Tax - Every guest shall pay a tax of P0.50 per day or a fraction thereof, which amount shall be collected by the hotel added to the usual daily rate the hotel is charging its guests. The hotel shall in return pay this tax to the Municipal Government not later than the first five days of the succeeding month aside from other taxes due to the government as may be provided for in other ordinances.
SECTION 4. Penalty - Any hotel operator found guilty for violation of any provision of this Ordinance shall be sentenced to an imprisonment of not less than ten (10) days but not more than thirty (30) days, or to pay a fine of not less than Twenty-Five (P25.00) Pesos but not more than Seventy (P70.00) Pesos or both such fine and imprisonment in the discretion of the Court. Violation of this Ordinance is a ground for revocation of the business permit so issued, or denial of renewal thereof.
SECTION 5. This ordinance shall take effect seven (7) days after its approval.
